AN ORDINANCE AMENDING ARTICLE V. "JUNKED MOTOR
VEHICLES" OF CHAPTER 46 "NUISANCES" OF THE CODE OF
ORDINANCES, CITY OF EULESS, TEXAS, AS AMENDED, TO
DESIGNATE PERSONS WITH AUTHORITY TO ENFORCE SAID
ARTICLE AND TO GRANT RIGHT OF ENTRY TO SAID
PERSONS; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
Be it ordained by the City Council of the City of Euless, Texas:
I.
That Article V. "JUNKED VEHICLES" of Chapter 46 "NUISANCES" of the Code
of Ordinances, City of Euless, Texas, as amended, be hereby amended by the addition
thereto of a new Section 46 -148, to be entitled "Authority to Enforce; Right of
Entry ", which new section shall hereafter be and read as follows:
Section 46 -148. Authority to Enforce; Right of Entry
Any Euless Police Officer, and any other Euless employee whose duties include
enforcement of the provisions of this Code of Ordinances, are hereby authorized
to administer the procedures authorized by this Article, and any such police
officer or city employee may enter upon private property for the purposes
specified herein to examine a vehicle or vehicle part, obtain information as to
the identity of the vehicle, and remove or cause the removal a vehicle or vehicle
part. The Euless Municipal Court shall issue appropriate orders necessary to
enforce the procedures contained in this Article.
II.
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this
crdinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality
shall not affect any of the remaining phrases, clauses, sentences, paragraphs and
sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
III.
Saving Clause. That Chapter 46 of the Code of Ordinances, City of Euless,
Texas, as amended, shall remain in full force and effect, save and except as amended
by this ordinance.

IV.
Effective Date. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Euless City Charter and the laws of
the State of Texas.
PRESENTED AND GIVEN FIRST READING and approved at a regular meeting
of the Euless City Council on the 22 day of August 1995; by a vote
of 6 ayes, 0 nays and 0 abstentions.
