HomeMy WebLinkAbout1207 05-14-1996ORDINANCE NO. 1207 AN ORDINANCE AMENDING SECTION 14-2 "AMENDMENTS TO THE UNIFORM BUILDING CODE" OF ARTICLE I "IN GENERAL" OF CHAPTER 14 'BUILDINGS AND BUILDINGS REGULATIONS ", AND AMENDING SECTION 34-105 "AMENDMENTS TO THE FIRE CODE" OF ARTICLE IV "STANDARDS" OF CHAPTER 34 "FIRE PREVENTION AND PROTECTION' OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS, AS AMENDED; AMENDING PROVISIONS OF SAID UNIFORM CODES GOVERNING INSTANCES IN WHICH AUTOMATIC SPRINKLER SYSTEMS ARE REQUIRED IN APARTMENT HOUSES, HOTELS AND MOTELS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: That Section 14 -2, "AMENDMENTS TO THE UNIFORM BUILDING CODE" of Article I "IN GENERAL" of the Code of Ordinances, City of Euless, Texas, as amended, be hereby amended by the addition thereto of a new Subsection 16.5 "SECTION 3802(h)" which new Subsection shall hereafter be and read as follows: (16.5) Section 3802(h). Subsection (h) of Section 3802 is hereby amended to hereafter be and read as follows: (h) Group R Division 1 Occupancies An automatic fire sprinkler system shall be installed throughout multi — family structures (defined herein as Apartment Houses, Condominiums, or Townhouses) two (2) or more stories in height or containing four (4) or more dwelling units, regardless of any area separation walls, or containing any dwelling units located above a garage space or area designated for the parking or storage of motor vehicles, and such automatic sprinkler system shall also be installed in hotel or motel occupancies two (2) or more stories in height or containing twenty (20) or more guest rooms. Apartment buildings, Condominiums, or Townhouses three (3) or more stories in height shall be equipped with an automatic fire sprinkler system meeting NFPA Standard 13. Apartment buildings, Condominiums, or Townhouses two (2) stories or less in height shall be equipped with an automatic fire sprinkler system meeting, at a minimum, NFPA Standard 13R. Hotel or Motel occupancies shall be equipped with an automatic fire sprinkler system meeting NFPA Standard 13. ORDINANCE NO. 1207 PAGE 1 II. That Section 34 -104 "AMENDMENTS TO THE FIRE CODE" of Article IV "STANDARDS" of Chapter 34 "FIRE PREVENTION AND PROTECTION' of the Code of Ordinances, City of Euless, Texas, as amended, be hereby amended by the addition thereto of a new Subsection 15.5 "Section 10.507(h) ", which new subsection shall hereafter be and read as follows: (15.5) Section 10.507(h). Subsection (h) of Section 10.507 "REQUIRED INSTALLATIONS OF AUTOMATIC FIRE EXTINGUISHING SYSTEMS" shall be hereby amended to hereafter be and read as follows: (h) Group R. Division 1 Occupancies. Severability Clause That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. L UT Saving Clause. That Chapters 14 and 34 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. ORDINANCE NO. 1207 PAGE 2 V. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas; PROVIDED, however, that the more stringent fire sprinkler requirements imposed hereby shall not apply to any building or development for which site plan approval or development plan approval has been obtained prior to the date of adoption of this ordinance.
