AN ORDINANCE AMENDING CHAPTER 30,'FEES, "SECTION
30 -15 'FIRE PREVENTION CODE" AND SECTION 30 -38
'MISCELLANEOUS FEES," OF THE CODE OF ORDINANCES,
CITY OF EULESS; TO REVISE THE FEES LISTED IN SAID
SECTION; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVING CLAUSE; AND PROVIDING AN
EFFECTIVE DATE
WHEREAS, the City Council of the City of Euless, Texas, after study, finds that certain
fees contained in the current fee structure do not provide adequate reimbursement to the City
of Euless for the goods and services furnished in return for such fees; and
WHEREAS, the City Council further finds that the fees contained in this ordinance
provide such adequate reimbursement;

NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Euless,
SECTION I
That Chapter 30 "Fees," Section 30 -15 "Fire Prevention Code," of the Code of Ordinances,
City of Euless, Texas be hereby amended as follows:
Sec. 30 -15.
(r) Flammable and combustible liquids
(4) Use of underground tanks for storage and dispensing $100.00
of flammable and combustible liquids
(7) Operation of refineries, distilleries, chemical plants $100.00
or similar facilities
(10) Above ground fuel tanks for storage and dispensing $100.00
of class I flammable and combustible liquids
(ii) Open burning:
(1) Display fires, entertainment events $20.00
(2) Warming fires or portable heating appliances $20.00
(4) Open pit barbecues $20.00
(zz) Reinspection fee (third visit and thereafter) $30.00
(bbb) Hydrant flow test $20.00
(III) (Add) Private agency request to conduct a fire or life safety $40.00
inspection for a license or agency certification
SECTION II
That Chapter 30, "Fees," Section 30 -27 'Recreation Areas or Facilities" of the Code of
Ordinances, City of Euless, Texas be hereby amended as follows:
(d) Simmons Recreation Center (J. A. Carr Park) and Ruth Millican Center:
(2) Deposit
No food or drinks served $100.00
If food or drinks are served $500.00
SECTION III
That Chapter 30 "Fees," Section 30 -38 "Miscellaneous Fees" of the Code of Ordinances, City
of Euless, Texas be hereby amended as follows:
Fire department photographic reproductions:
(Delete Minimum charge)
Per unit $2.00
Plus processing costs actual costs
SECTION IV
Severability Clause. That it is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and
if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared
invalid or unconstitutional by the valid judgement or decree of any court of competent
jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases,
clauses, sentences, paragraphs and sections of this ordinance, since the same would have
been enacted by the City Council without the incorporation in this ordinance of any such
invalid or unconstitutional phrase, clause, sentence, paragraph or section.
SECTION V
Saving Clause. That Chapter 30 of the Code of Ordinances, City of Euless, Texas, as
amended, shall remain in full force and effect, save and except as amended by this
ordinance.

SECTION VI
Effective Date. This ordinance shall be in full force and effect from and after its passage and
publication as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST AND FINAL READING AND APPROVED at a regular
meeting of the Euless City Council on the 25th day of June , 1996, by a vote of 6 ayes,
nays and 0 abstentions.
