HomeMy WebLinkAbout1223 12-12-1996ORDINANCE NO. 1223 AN ORDINANCE AMENDING CHAPTER 84 OF THE CODE OF ORDINANCES, IDENTIFIED AS THE UNIFIED DEVELOPMENT CODE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON CERTAIN PROPERTY OUT OF THE SOLOMON HUITT SURVEY, A -705 FOR A CHANGE OF ZONING FROM L -1 (LIMITED INDUSTRIAL) DISTRICT TO PD (PLANNED DEVELOPMENT), FOR SMALL LOT SINGLE FAMILY DEVELOPMENT (5.13 UNITS PER ACRE); PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning Commission conducted a public hearing on November 19, 1996, in conjunction with Zoning Case No. ZC- 96 -21, and has rendered a recommendation to the City Council with respect to same. WHEREAS, City Council conducted a public hearing on December 12, 1996, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classification of that 5.43 acres of land generally located East of International Drive at Sixpence Lane, more specifically described in Exhibit A, attached hereto and made a part hereof, be changed from L -1 (Limited Industrial) to PD (Planned Development) subject to all the R -11- zoning district standards described on the attached Exhibit "B ". Where said development standards described in Exhibit "B" differ from those of the R-11- standards by being more or less stringent, the standards described in exhibit "B" shall govern. The manner in which these standards shall be applied to this property shall be as specific in a Specific Use Permit, which may only be granted by the City Council. SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to be comprehensive zoning ordinance of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two- Thousand Dollars ($2,000) and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendment to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless, as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. MINIMUM LOT WIDTH AT THE BUILDING LINE TO BE 49 FEET.
