HomeMy WebLinkAbout1225 12-12-1996ORDINANCE NO. 1225 AN ORDINANCE AMENDING CHAPTER 84 'UNIFIED DEVELOPMENT CODE" OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS, AS AMENDED; BY AMENDING THE MINIMUM EXTERIOR FACADE REQUIREMENTS IN CERTAIN RESIDENTIAL, COMMERCIAL AND INDUSTRIAL ZONING DISTRICTS; PROVIDING FOR A SEVERABILITY CLAUSE; SAVINGS CLAUSE; PENALTY FOR VIOLATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, in order to preserve and enhance the permanency and quality of these neighborhoods and to encourage high quality future development, an increased minimum exterior facade requirement is deemed necessary. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TARRANT COUNTY, TEXAS: SECTION I THAT Section 84 -110, entitled "C -1 Neighborhood Business District ", be amended to read as follows: 84- 110(c)(7) Minimum Exterior Facade - 100 percent masonry facade on all wall elevations. SECTION II THAT Section 84 -111, entitled "C -2 Community Business District ", be amended to read as follows: 84- 111(c)(6) Minimum Exterior Facade - 100 percent masonry facade on all wall elevations. SECTION III THAT Section 84 -101, entitled "R -1C Single Family Custom Dwelling District', be amended to read as follows: 84- 101(c)(10) Minimum Exterior Facade - 90 percent masonry facade on all wall elevations. SECTION IV THAT Section 84 -102, entitled "R -1 Single Family Detached Dwelling District', be amended to read as follows: 84- 102(c)(10) Minimum Exterior Facade - 90 percent masonry facade on all wall elevations. SECTION V THAT Section 84 -104, entitled "R -1A Single Family Attached Dwelling District', be amended to read as follows: 84- 104(c)(10) Minimum Exterior Facade - 90 percent masonry facade on all wall elevations. SECTION VI THAT Section 84 -105, entitled 'R -2 Two Family Dwelling District', be amended to read as follows: 84- 105(c)(9) Minimum Exterior Facade - 90 percent masonry facade on all wall elevations. SECTION VII THAT Section 84 -107, entitled "R -3 Multiple Family Low Density Dwelling District' and in addition being applicable to the R -4 and R -5 Multi - Family zoning districts, be amended to read as follows: 84- 107(c)(24) Minimum Exterior Facade - 90 percent masonry facade on all wall elevations. SECTION VIII THAT Section 84 -113, entitled "L -1 Limited Industrial District', be amended to read as follows: 84- 113(c)(6) Minimum Exterior Facade - 100 percent masonry facade on all wall elevations. SECTION IX THAT Section 84 -114, entitled 1 -1 Light Industrial District', be amended to read as ORDINANCE NO. 1225, PAGE 2 OF 4 follows: 84- 114(c)(5) Minimum Exterior Facade - 100 percent masonry facade on all wall elevations. SECTION X THAT Section 84 -115, entitled 1 -2 Heavy Industrial District', be amended to read as follows: 84- 115(c)(5) Minimum Exterior Facade - 100 percent masonry facade on all wall elevations. SECTION XI THAT Section 84 -112, entitled "TX -10 Texas Highway 10 Multi -Use District', be amended to read as follows: 84- 112(c)(7) Minimum Exterior Facade - 100 percent masonry facade on all wall elevations. SECTION XII SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION XIII SAVINGS CLAUSE. That Sections 84 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION XIV PENALTY CLAUSE. Any person, firm or corporation violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two Thousand Dollars ($2,000.00) ORDINANCE NO. 1225, PAGE 3 OF 4 for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION XV EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST AND FINAL READING and approved at a regular meeting of the Euless City Council on the 12th day of December, 1996; by a vote of 7 ayes, o nays and o abstentions.
