AN ORDINANCE AMENDING CHAPTER 82 'TRAFFIC AND MOTOR VEHICLES,- ARTICLE III
"OPERATION OF VEHICLE," SECTION 82-62 "SPEED LIMITS —ON CERTAIN STREETS AND
PORTIONS OF STREETS"; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING
A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, the City of Euless has determined upon the basis of engineering and traffic investigation that
the prima facie speed limits set forth as follows are reasonable and safe and declare that such prima facie
speed limits shall be effective when appropriate signs giving notice thereof are erected at such intersection
or other place or part of the street or highway;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, that
CHAPTER 82 "TRAFFIC AND MOTOR VEHICLES," ARTICLE III "OPERATION OF VEHICLE," SECTION
82-62 "SPEED LIMITS — ON CERTAIN STREETS AND PORTIONS OF STREETS," be hereby amended
in its entirety as follows:
SECTION I.
Upon the basis of an engineering and traffic investigation made as authorized by the provisions of Vernon's
Ann. Civ. St. art. 6701d, Sections 167 and 169 regulating traffic on highways, the following prima facie
speed limits indicated in this section for vehicles are hereby determined and declared to be reasonable and
safe; such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named
streets and highways, or parts thereof, described in Exhibit A attached hereto:
SECTION IL
Penalty for violation. Any person, firm or corporation violating any of the terms and provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in
accordance with Chapter 1, "General Provisions," Section 1 -12, "general Penalty," Euless Code of
Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such
hereunder.
SECTION III.
Severability Clause. That it is hereby declared to be the intention of the City Council that the section,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause
sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation in this ordinance of any
such invalid or unconstitutional phrase, clause, sentence, paragraph or section.
SECTION IV.
Saving Clause. Chapter 82 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain
in full force and effect, save and except as amended by this ordinance.
SECTION V.
Effective Date. This ordinance shall be in full force and effect from and after its passage and publication
as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST AND FINAL READING AND APPROVAL at a Regular Meeting of the
Euless City Council on the 16 day of January 1997, by a vote of 6 ayes, 0 nays, and
0 abstentions.
