HomeMy WebLinkAbout1246 10-14-1997ORDINANCE NO. 1246 AN ORDINANCE AMENDING CHAPTER 84 OF THE CODE OF ORDINANCES, IDENTIFIED AS THE UNIFIED DEVELOPMENT CODE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON LOT 1, BLOCK 1, ANDERTON ADDITION; LOTS 1R, 2R, 3R, 4R, 5R, BLOCK A, BACCARAC INDUSTRIAL PARK; LOTS 4RA, 4RB, 4RC, 4RD, BLOCK A, BELL INDUSTRIAL DISTRICT; LOT 1, BLOCK 1, FERGUSON ADDITION; LOTS A& B, JOHN GROVES ADDITION; TRACTS 3G, 3K, 1C1, 1132, 3C1, 31-1, 1F1A, 3C1A, JOHN GROVES SURVEY A -599; TRACTS 2B1 & 2A1A, KITTY HOUSE SURVEY A -678; LOT B, BLOCK A, LOTS 1A, 1B, 9 & 10, AND REMAINING PART, BLOCK C, AND LOTS A & D, BLOCK E, INTERNATIONAL REGIONAL INDUSTRIAL COMPLEX; LOT 1, BLOCK 1, J. W. LEWELLYN ADDITION; TRACT 1C, JAMES MATSON SURVEY A -1080; TRACTS 1D1, 1D2, 1D4A, 1D6, 1D1A, 1132A, 1135, 1D1B, H. MCCOY SURVEY A -1073; LOT 1 PARK CENTER ADDITION; AND LOT 1R, BLOCK 1, TEXAS CONTINENTAL EXPRESS, INC. ADDITION FROM THE CURRENT ZONING CLASSIFICATIONS TO TX -10 (TEXAS TEN DISTRICT); PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning Commission has conducted a public hearing on September 16, 1997, in conjunction with Zoning Case No. #97- 32 -ZC, and has rendered a recommendation to the City Council with respect to same; WHEREAS, City Council has conducted a public hearing on October 14, 1997, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classification specifically described in Exhibit "A" (attached hereto and made a part hereof), be changed from the current zoning classification to TX -10 (TEXAS TEN DISTRICT), in accordance with the detailed zoning graphic labeled as Exhibit "B ". Said property described above shall be subject to all the safeguards and conditions set forth on said site plan described herein. Said site plan shall be applicable only to the property described herein. SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the comprehensive zoning ordinance of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two- Thousand Dollars ($2,000) and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendment to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless, as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 14th day of October, 1997, by a vote of 6 ayes, 0 nays, and 0 abstentions.
