HomeMy WebLinkAbout129 05-24-1960ORDINANCE NO. 129 SPEED ZONE ORDINANCE AN ORDINANCE ALTERING THE PRIMA FACIE SPEED LIMITS ESTABLISHED FOR VEHICLES UNDER THE PROVISIONS OF SECTION 8 OF ARTICLE 827a, VERNON'S TEXAS PENAL CODE, UPON THE BASIS OF AN ENGINEERING AND TRAFFIC INVESTIGATION, UPON CERTAIN STREETS AND HIGHWAYS, OR PARTS THEREOF, WITHIN THE CORPORATE LIMITS OF THE CITY OF EULESS, AS SET OUT IN THIS ORDINANCES AND PROVIDING A PENALTY OF A FINE NOT TO EXCEED $200.00 FOR THE VIOLATION OF THIS ORDINANCE. WHEREAS, Section 8 of Article 827a, Vernon's Penal Code of the State of Texas, provides that whenever the governing body of the City shall determine upon the basis of an engineering and traffic investi- gation that any prima facie speed therein set forth is greater or less than is reasonable or safe under the conditions found to exist at any intersection or other place or upon any part of a street or highway, with the City taking into consideration the width and condition of the pavement and other oire4stances on such portion of said street or highway, as well as the usual traffic thereon, said governing body may determine and declare a reasonable and safe prima facie speed limit thereat or thereon by the passage of an ordinance, which shall be effective when appropriate signs giving notice thereof are erected at such intersection or other place or part of the street or highway now therefore. BE IT ORDAINED BY the City Council of the City of Euless, Texas: Section 1. Upon the basis of an engineering and traffic investigation heretofore made as authorized by the provisions of Section 8 of Article 827 &, Vernon's Texas Penal Code, the following prima facie speed limits hereafter indicated for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: A. On State Highway 183, Main Lanes 1. From the west City limit of Euless at Station 670 ;00, Northeasterly to 11.650 miles Northeast of the west City Limit, 60 miles per hour (day) --55 miles per hour (night). 29 From 1.650 miles northeast of the Wast City Limit northeasterly to 30409 miles northeast of the west City Limit, 50 miles per hour. 3. From 3.409 miles northeast of the west City Limit, northeasterly to 3.597 miles northeast of the east City Limit, 45 miles per hour. 4. ^rom 3.597 miles northeast of the crest City Limit r northeasterly to 3.786 miles northeast of the west City Limit, at a designated School Crossir.. Zone, during school boars and while a portable school warning sign is placed along said 0.189 mile strip of highway, 35 Wailes per hour. At other than school hours, the speed limit along said 0.189 mile strip of h13hway shall bA 45 miles per hour. 5. From 3.786 miles northeast of the west city limit, easterly to 2.688 miles west of the east City Limit of Buless, 45 miles per hour. 6. From 2.688 miles west of the east City Limit, easterly to 2.299 miles west of the east City Limit, 50 miles per hour. 7. Prom 2.299 miles west of the east City Limit of Euleass Masterly to the east City Limit at Station 1015488.3, 60 miles per hour (day) - -55 miles per hour (night). B. On State Highway 183, Frontage Roads 1. From the beginning of the Frontage Roads at Station 8524320 easterly 0.478 mile to the and of the frontage Roads at Station 877153.5, 30 miles per hour. Section 2. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and upon conviction thereof shall be fined in any sum not more than two hundred ( *200.00) dollars.
