AN ORDINANCE AMENDING CHAPTER 30 "FEES",
SECTION 30 -28 "LIBRARY ", OF THE CODE OF
ORDINANCES, CITY OF EULESS, TEXAS, PROVIDING
A SEVERABH ITY CLAUSE; PROVIDING A SAVING
CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council deems it necessary to amend the established fees for the
Library Meeting Room,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS, THAT:
SECTION 1
Chapter 30, "Fees ", Section 30 -28, "Library" of the Code of Ordinances, City of Euless,
Texas, be hereby amended as follows:
Amend Subsections (6) (a), (b), (c), (d) and (e) in their entirety to read:
(a) Library Meeting Room Charge
$35.00 per hour (3 hour minimum), with no audio /visual equipment, including
building attendant
$30.00 per hour (4 hours and above), with no audio /visual equipment, including
building attendant
$43.00 per hour (3 hour minimum), with audio /visual equipment and media
consultant
$38.00 per hour (4 hours and above), with audio /visual equipment and media
consultant
(b) Payment policy. Fifty percent of room rate must be paid to secure room
reservation.
This security deposit is refundable with cancellation up to 60 days prior to the
event. If reservation is canceled less than 60 days prior to the event, the
security deposit is non - refundable. The balance of the room charge must be
paid 14 days in advance of the event. The room charge balance is non - refundable.
(c) Refundable damage deposit.
No food or drinks served ...$100.00
If food or drinks are served . $500.00
This deposit will serve as security for any additional cleanup of the facility and will
be applied toward any damage to the facility. This deposit is to be paid at the time
the room balance is paid 14 days prior to the event. The damage deposit will be
refunded to the patron within ten business days after the date of the reservation
after a thorough inspection of the meeting facility. The damage deposit will also
be refundable in case of cancellation of event.
(d) Security officer. $20.00 per hour, three -hour minimum. Any event with over 100
persons in attendance will be reviewed to see if a security officer should be
present. Any event with over 150 persons in attendance will be required to employ
an officer. The officer will be paid by the renter at the end of the evening.
(e) Catering. Six percent of adjusted gross sales (gross less sales tax and tip). An
approved caterers' list will be available to those wishing to have an event catered.
Approval of a caterer involves providing a certificate of insurance with the City of
Euless named as an additional insured on said certificate, copy of a certificate of
health, and having signed a catering agreement with the city.
Delete: Subsections (f) and (g)
SECTION II
Severabiliq Clause. It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any
phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or
unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such
invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences,
paragraphs and sections of this ordinance, since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase,
clause, sentence, paragraph or section.
SECTION III
Saving Clause. Chapter 30 of the Code of Ordinances, City of Euless, Texas, as
amended, shall remain in full force and effect, save and except as amended by this ordinance.
SECTION IV
Effective Date. This ordinance shall be in full force and effect from and after its passage
and publication as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST AND FINAL READING at a regular meeting of the
Euless City Council on the 25 day of November 1997, by a vote of 6 ayes,
0 nays and 0 abstentions.
