HomeMy WebLinkAbout1302 01-27-1998ORDINANCE NO. 1302 AN ORDINANCE AMENDING CHAPTER 30, "FEES ", SECTION 30 -28, "LIBRARY ", OF THE EULESS CODE OF ORDINANCES; PROVIDING A SAVING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL, CITY OF EULESS, TEXAS: That Chapter 30, "Fees ", Section 30 -28, "Library", subsections (1) through (5) and subsection (7) be deleted and the following be added: TYPE OF MATERIAL LOAN PERIOD LIMIT FINE PER DAY PER ITEM Books, cassettes, CDs, Nonfiction book bags, film strips 3 weeks 2 per subject $0.20 Videocassettes 1 week 5 titles $0.20 Interlibrary Loan 3 weeks None $0.50 16mm Film (borrowed from Northeast Texas Library 2 days None $2.00 System) Maximum fine to accrue on $0.20 & $0.50 items -- $5.00 Duplicate library card -- $2.00 Items lost or damaged -- Replacement cost plus $5.00 per item reprocessing fee Items not listed in replacement data bases -- $15.00 for children's book $25.00 for adult hand cover book $10.00 for trade paperback book $ 5.00 for mass market paperback Missing bar code - $1.00 Cost of sending overdue notice by certified mail -- Actual cost of postage Use of copier & microfiche reader /printer -- $0.10 per copy Nonresident fees for residents outside cities with reciprocal agreements (nonresidents must purchase a $5.00 punch card and must present both punch card and library card). $0.25 per item Fees are waived for students attending public schools in Euless while residing in the City of Fort Worth, and for their families and for teachers of schools in Euless. SAVING CLAUSE. That applicable chapters of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND APPROVED ON THE FIRST AND FINAL READING on the 27 day of - January, 1998, at a regular meeting of the City Council of the City of Euless, Texas, by a vote of 7 ayes, 0 nays and 0 abstentions.
