HomeMy WebLinkAbout1303 02-10-1998ORDINANCE NO. 1303 AN ORDINANCE OF THE CITY OF EULESS, TEXAS, APPROVING RETAIL BASE RATE REDUCTIONS FOR TEXAS UTILITIES ELECTRIC COMPANY, PROVIDING AN EFFECTIVE DATE THEREFOR, PROVIDING CONDITIONS UNDER WHICH THE RATE SCHEDULES AND SERVICE REGULATIONS OF TEXAS UTILITIES ELECTRIC COMPANY MAY BE CHANGED, MODIFIED, AMENDED OR WITHDRAWN, FINDING AND DETERMINING THAT THE MEETING AT WHICH THIS ORDINANCE IS PASSED IS OPEN TO THE PUBLIC AS REQUIRED BY LAW; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS; On December 22, 1997, Texas Utilities Electric Company filed with the City Council of the City of Euless a Petition and Statement of Intent to implement base rate reductions for its retail electric service customers within the municipality, which base rate reductions are components of a settlement reached among various parties set forth in the Stipulation and Joint Application for Approval Thereof filed with the Public Utility Commission of Texas on December 17. 1997. II. The retail base rate reduction tariffs filed by Texas Utilities Electric Company with the City as evidenced by Rider RRD - Residential Rate Reduction, Rider GSRD - General Services Rate Reduction, and Rider RD - Rate Reduction are hereby approved on an interim basis effective January 1, 1998, as the rate schedules implementing such retail base rate reductions within the corporate limits of the City of Euless, provided however, in the event the Public Utility Commission of Texas upon review of the settlement reached among various parties as set forth in the Stipulation and Joint Application for Approval Thereof, hereinbefore noted and review of Texas Utilities Electric Company cost of service, shall establish further rate reductions, then in such event, such further reductions established by the final order the Public Utility Commission of Texas shall be the approved rate schedules implementing the retail base rate reductions within the corporate limits of the City of Euless, retroactive to January 1, 1998, until such time as the rate schedules of Texas Utilities Electric Company may be changed, modified, amended or withdrawn with the approval of the City Council of the City of Euless. 111. The aforesaid rate schedules herein approved shall be effective from January 1, 1998, unless the Public Utility Commission of Texas orders retail base rate reductions for Texas Utilities Electric Company be placed in effect at an earlier date in the territories over which the Public Utility Commission of Texas exercises original jurisdiction in which event, such earlier date shall be the effective date for the retail base rate reductions herein approved. IV. Notwithstanding any other provision of this ordinance, the rates authorized for electric service in the City of Euless, shall not, in any event, exceed the lowest rates available to residents of any other municipality served by Texas Utilities Electric Company. V. The filing of the rate schedules herein referenced and implementing such retail base rate reductions shall constitute notice to the consumers of electricity within the City of Euless of the availability and application of such rate schedules. VI. Nothing in the ordinance shall be construed now or hereafter as limiting or modifying in any manner the right and power of the City Council of the City of Euless, Texas, under the law to regulate the rates, operations and services of Texas Utilities Electric Company. VII. It is hereby officially found and determined that the meeting at which this ordinance is passed is open to the public as required by law and that public notice of the time, place and purpose of said meeting was given as required. V Ill. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. Ordinance No. 1303, Page 2 of 3 IX. That the Code of Ordinances, City of Euless, Texas, shall remain in full force and effect, save and except, as amended by this ordinance. X. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST READING and approved at a regular meeting of the Euless City Council on the 10th day of February 1998, by a vote of 7 ayes, 0 nays, and 0 abstentions.
