HomeMy WebLinkAbout1304 01-13-1998ORDINANCE NO. 1304 AN ORDINANCE AMENDING SECTION 82-63 "SAME — SCHOOL ZONES" AND SECTION 82-62 "SAME — ON CERTAIN STREETS AND PORTIONS OF STREETS" OF ARTICLE III "OPERATION OF VEHICLES" OF CHAPTER 82 "TRAFFIC AND MOTOR VEHICLES" OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, AS AMENDED, TO ADD A NEW SUBSECTION (c) "SCHOOL CROSSINGS ENUMERATED "; DESIGNATING SPEED LIMITS WITHIN THE AREAS OF CERTAIN SCHOOL CROSSING AREAS; REMOVING DUPLICATED ITEMS; PROVIDING A SAVING CLAUSE; PROVIDING A SEVERABILITY CLAUSE, AND AN EFFECTIVE DATE. WHEREAS, school crossing areas are currently listed within the general speed limit section of the Euless Code of Ordinances; and WHEREAS, the Euless City Council finds and determines that the health, safety, welfare and convenience of the public would be better served by listing said school crossing areas in the section of the Euless Code of Ordinances which lists general school zones; and WHEREAS, the City of Euless desires to remove duplicated items associated with the general speed limits and school crossing areas to avoid confusion; and WHEREAS, the following ordinance accomplishes said purpose. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: Section I. That Section 82 -63 "Same -- School zones" of Article III. "Operation of Vehicle" of Chapter 82 "Traffic and Motor Vehicles" of the Code of Ordinances of the City of Euless, as amended, be hereby amended by the addition thereto of a new Subsection (c) "School crossings enumerated ", which new Subsection shall hereafter be and read as follows: (c) School crossing enumerated. On that portion of those streets or highways designated hereunder as school crossings or school crossing areas, based upon engineering and traffic investigations made as authorized by law, the following prima facia speed limits indicated in this Subsection for vehicles are hereby determined and declared to be reasonable and safe; and such speed limits are hereby fixed at the rate of speed indicated for vehicles traveling upon the named streets and highways, or parts thereof, described as follows: Street Euless Blvd., W. (State Highway 10) Block Number/ (portion of street 200 -500W (E /B lane only) (school crossing) Maximum Speed Extent (mph) 100 feet west of Norman Dr. east to 35 or 45 100 feet east of Martha St. (as signed) 2. Euless Blvd., W. 200 -500W 100 feet east of Martha St. west to 35 or 45 (State Highway 10) (W /B lane 250 feet east of Ector Dr. (as signed) ORDINANCE NO. 1304 , PAGE 1 OF 3 only) (school crossing) 3. Airport Frwy., W. 200 -600W 100 feet west of Byers St. west to 25 or 40 (State Highway 183) (W /B Frtg. Rd.) 100 feet west of Ector Dr. (as signed) (school crossing) 4. Industrial Blvd., N. 300 -600N 260 feet south of Trojan Trail north 35 or 45 (State Highway 157) (school to 500 feet north of Midway Dr. (as signed) crossing) Section II. That in Section 82 -62 "Same -- On certain streets and portions of streets" of Article III "Operation of Vehicle" of Chapter 82 "Traffic and Motor Vehicles" of the Code of Ordinances of the City of Euless, as amended, the following items are hereby removed and repealed for speed limits as follows: Section III. Saving Clause. That Chapter 82 of the Code of Ordinances, City of Euless, Texas, as amended, shall be in full force and effect, except as amended by this ordinance. Section IV. Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. Section III. Saving Clause. That Chapter 82 of the Code of Ordinances, City of Euless, Texas, as amended, shall be in full force and effect, except as amended by this ordinance. Section IV. This ordinance shall be in full force and effect from and after its passage and publication by the Euless City Charter and the laws of the State of Texas.
