HomeMy WebLinkAbout1325 05-12-1998ORDINANCE NO. 1325 AN ORDINANCE AMENDING CHAPTER 84 OF THE CODE OF ORDINANCES, IDENTIFIED AS THE UNIFIED DEVELOPMENT CODE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON THE EDWARD TAYLOR SURVEY, ABSTRACT 1550, PORTIONS OF TRACTS 1B, 161, 1C, 1C2 FROM THE CURRENT ZONING CLASSIFICATIONS TO C -2 (COMMUNITY BUSINESS DISTRICT) AND PD (PLANNED DEVELOPMENT DISTRICT); PROVIDING FORA SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning & Zoning Commission has conducted a public hearing on April 21, 1998, in conjunction with Zoning Case No. #98- 17 -ZC, and has rendered a recommendation to the City Council with respect to this case, WHEREAS, the City Council has conducted a public hearing on May 12, 1998, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION THAT the official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classifications specifically described in Exhibit "A" (attached hereto and made a part hereof), be changed from the current zoning classifications to C -2 (Community Business District) and PD (Planned Development District), in accordance with the detailed zoning graphic labeled as Exhibit "B ". The Planned Development District shall conform to C -1 (Neighborhood Business District) regulations, with certain uses eliminated and with specific development standards as described on the Development Plan labeled "Proposed Retail /Office Development Site Plan ", which is attached hereto and made a part hereof. THEREFORE as a result of this zoning change the following property shall be zoned C -2; 17.52 acres situated in the Edward Taylor Survey, Abstract 1550, Euless, Tarrant County, Texas, also being all of that certain tract conveyed to Marion G. Spencer and Sharron M. Spencer as recorded in Volume 10900, Page 2134, Deed Records, Tarrant County, Texas; a portion of a 8.078 acre tract conveyed to First Baptist Church of Euless as recorded in Volume 8338, Page 428, Deed Records, Tarrant County, Texas; and a portion of a 9.887 acre tract conveyed to First Baptist Church, Euless, inc., as recorded in Volume 7880, Page 1646, Deed Records, Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a 112 inch iron rod found at the intersection of the south line of Glade Road (variable R.O.W.) and the east line of Main Street; THENCE: N 88 °32'11" E along said south line for a distance of 257.06 feet; THENCE: N 89 °43'04" E continuing along said south line for a distance of 283.71 feet: THENCE: N 89 °01'03" E for a distance of 653.12 feet to a 518 inch iron rod found in the west line of a tract conveyed to M. D. Howeth as recorded in Volume 12044, Page 1586, Deed Records, Tarrant County, Texas; THENCE: S 00 006'45" W along said west line for a distance of 268.34 feet to a 112 inch iron rod found for corner; THENCE: West for a distance of 229.71 feet; THENCE: N 00 °06'45" E for a distance of 50.12 feet; THENCE: West for a distance of 150.00 feet; THENCE: S 00 °06'45" W for a distance of 452.94 feet; THENCE: S 59 °39'07" W for a distance of 316.69 feet to a 112 inch iron rod found at the north line of Cinnamon Ridge Addition according to the plat thereof recorded in Volume 388 -152, Page 54, Plat Records, Tarrant County, Texas; THENCE: S 89 021'50" W along said north line for a distance of 598.39 feet to a 112 iron rod found in the aforementioned west line of N. Main Street; THENCE: N 04 °07'11" E along said west line for a distance of 820.77 feet to the POINT OF BEGINNING and CONTAINING 17.52 acres, more or less. AND as a result of this zoning change the following property shall be zoned PD (Planned Development) in accordance with the approved Development Plan labeled "Proposed Retail /Office Development Site Plan ", which property shall be subject to all the safeguards and conditions set forth on the Development Plan herein referred to. Said Development Plan shall be applicable only to the property described as follows: 6.72 acres situated in the Edward Taylor Survey, Abstract 1550, Euless, Tarrant County, Texas, also being a portion of a 8.078 acre tract conveyed to First Baptist Church of Euless as recorded in Volume 8338, Page 428, Deed Records, Tarrant County, Texas; and a portion of a 9.887 acre tract conveyed to First Baptist Church, Euless, Inc., as recorded in Volume 7880, Page 1646, Deed Records, Tarrant County, Texas, and being more particularly described as follows: BEGINNING at a 1/2 inch iron rod found at the northwest corner of Oak Hollow Addition according to the plat thereof recorded in Volume 388 -207, Page 88, Plat Records, Tarrant County, Texas; THENCE: S 00 °06'45" W along the west line of said Oak Hollow Addition for a distance of 614.77 feet; THENCE: S 88 °18'15" W for a distance of 401.31 feet to the northeast corner of Nutmeg Lane, said point also being in a curve to the right having a radius of 260.00 feet and a chord of 160.25 feet; THENCE: southwesterly along said north line and with said curve for an arc distance of 162.90 feet: THENCE: S 89 °21'50" V1( continuing along said north line for a distance of 99.70 feet to a 112 inch iron rod found at the southeast corner of Lot 9, Block F, Cinnamon Ridge Addition according to the plat thereof recorded in Volume 388- 152, page 54, Plat Records, Tarrant County, Texas; THENCE: N 00 °02'24" E along the east line of said Lot 9, for a distance of 116.15 feet to a 112 inch iron rod found for corner; THENCE: N 59 °39'07" E for a distance of 316.69 feet; THENCE: N 00 °06'45" E for a distance of 452.94 feet: THENCE: East for a distance of 150.00 feet; THENCE: S 00 °06'45" W for a distance of 50.12 feet; THENCE: East for a distance of 229.71 feet to the POINT OF BEGINNING and CONTAINING 6.72 acres of land, more or less. SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the comprehensive zoning ordinance of the City of Euless hereby made, shall be deerned guilty of a misdemeanor and, upon conviction thereof, shall be liable to a 4.5ne in an amount not to exceed Two - Thousand Dollars ($2,000) and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendrnent to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless, as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. SECTION ION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 12th day of May, 1998, by a vote of 7 ayes, 0 nays, and 0 abstentions.
