AN ORDINANCE AMENDING CHAPTER 82 `TRAFFIC AND MOTOR VEHICLES,
"ARTICLE III `OPERATION OF VEHICLE," SECTION 82 -62 `SPEED LIMITS --ON
CERTAIN STREETS AND PORTIONS OF STREETS "; PROVIDING A PENALTY
FOR VIOLATION THEREOF, PROVIDING A SEVERABlLITY CLAUSE,
PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE
WHEREAS, the City of Euless desires to change the existing speed limit on the portion of South Pipeline
Road which lies within the City Limits and a portion of Westpark Way;
WHEREAS, the reduced speed limit of 20 MPH on South Pipeline Road was established for construction
along South Pipeline Road and has since been completed;
WHEREAS, the reduced speed limit is no longer needed on South Pipeline Road;
WHEREAS, the existing speed limit of 30 MPH on Westpark Way was established due to roadway
geometry and safety concerns;
WHEREAS, Westpark Way has since been improved by realigning and widening and the design speed for
this improvement is 40 MPH;
NOW, THEREFORE, RE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS TEXAS, that
Chapter 82 "Traffic and Motor Vehicles," Article III "Operation of Vehicle," Section 82 -62 "Speed Limits - -On
Certain Streets and Portions of Streets," be hereby amended by replacing the existing speed limit of 20
MPH to 35 MPH on the portion of South Pipeline Road and the existing speed limit of 30 MPH to 40 MPH
on the portion of Westpark Way as follows:
SECTION 1.
Upon the basis of an engineering and traffic investigation made as authorized by the provisions of Vernon's
Ann. Civ. St. art. 6701d, § § 167 and 169 regulating traffic on highways, the prima facie speed limit of 35
MPH on the portion of South Pipeline Rd, between the block numbers of 1500 - 2100W and 40 MPH on the
portion of Westpark Way between the block numbers of 100 — 1200S is hereby determined and declared to
be reasonable and safe; such speed limit is hereby fixed at the rate of speed indicated for vehicles traveling
upon the named street, or parts thereof.
SECTION 2.
Penalty for violation. Any person, firm or corporation vitiating any of the terms and provisions of this
ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereat shall be fined in
accordance with Chapter "General Provisions," Section 1 -12 "General Penalty," Euless Code of Ordinances.
Each such violation shall be deemed a separate offense and shall be punishable as such hereunder.

Severability Clause. It is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation in this ordinance of any
such invalid or unconstitutional phrase, clause, sentence, paragraph or section
SECTION 4.
Saving Clause. Chapter 82 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in
full force and effect, save and except as amended by this ordinance.
SECTION 5.
Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as
provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST AND FINAL READING AND APPROVED at a Regular Meeting of the
Euless City Council on the 23`d day of February, 1999, by a vote of 7 ayes, 0 nays, and 0
abstentions.
