HomeMy WebLinkAbout1365 05-24-1999ORDINANCE NO. 1365 AN ORDINANCE AMENDING CHAPTER 84 OF THE CODE OF ORDINANCES, IDENTIFIED AS THE UNIFIED DEVELOPMENT CODE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON THE EDWARD TAYLOR SURVEY, ABSTRACT NO. 1550, TRACT 1A3, FROM THE CURRENT ZONING CLASSIFICATION OF C -1 (NEIGH- BORHOOD BUSINESS DISTRICT) TO TH (TOWNHOUSE DWELLING DISTRICT); PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on March 16, 1999, in conjunction with Zoning Case No. #99- 01 -ZC, and has rendered a recommendation to the City Council with respect to same: WHEREAS, City Council has conducted a public hearing on May 24, 1999, has considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that Edward Taylor Survey, Abstract No. 1550, Tract 1A3, specifically described in Exhibit "A" (attached hereto and made a part hereof), be changed from the current zoning classification of C -1 (Neighborhood Business District) to TH (Townhouse Dwelling District). SECTION 2 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the comprehensive zoning ordinance of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two- Thousand Dollars ($2,000), and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendment to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless. as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. SECTION 4 SAVINGS CLAUSE. Chapter 84 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance SECTION 5 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. TAYLOR SURVEY, Abstract No. 1550, Tarrant County, Texas, and being a portion of a tract of land conveyed to A.S. Hill, Jr., and wife, Shirley Arlene, by deed dated June 19, 1972, and recorded in Volume 5900, Page 698, of the Deed Records of Tarrant County, Texas; BEGINNING at a found 1 inch iron pipe found for the Southeast corner of a tract of land conveyed to HTI Oak Hollow Development Corporation by deed dated November 26, 1985, and recorded in Volume 8768, Page 2027, of the Deed Records of Tarrant County, Texas, same being on the North line of Cinnamon Ridge Phase IV, an Addition to the City of Euless, as recorded in Volume 388 -165, Page 53, of the Plat Records of Tarrant County, Texas; THENCE with the East line of said HTI Oak Hollow Development Corporation tract North 00 degrees 45 minutes 00 seconds East (called North 00 degrees 09 minutes 25 seconds East) — 299.82 feet (called 299.50 feet) to a found 5/8 inch iron rod, THENCE South 89 degrees 48 minutes 11 seconds East, (called North 89 degrees 19 minutes 08 seconds East) 400.98 feet (called 400.11 feet) to a found '/2 inch iron rod for the Northwest corner of a tract of land conveyed to the State of Texas, by deed dated February 27, 1986, and recorded in Volume 8469, Page 504, of the Deed Records of Tarrant County, Texas; THENCE with the West line of said State of Texas tract South 32 degrees 12 minutes 51 seconds East 92.45 feet to a found '/2 inch iron rod for the point of curvature of a curve to the left having a radius of 11,689.16 feet, a central angle of 01 degrees 17 minutes 24 seconds; THENCE with said curve to the left an arc length of 263.19 feet to a set '/2 inch iron rod for the Southwest corner of said State of Texas tract, same being on the North line of said Cinnamon Ridge Phase IV; THENCE with the North line of said Cinnamon Ridge Phase IV, North 89 degrees 54 minutes 56 seconds West, (called South 89 degrees 31 minutes 11 seconds West) 597.07 feet (called 593.0 feet) to the POINT OF BEGINNING and containing 3.42 acres of land, more or less.
