HomeMy WebLinkAbout1374 08-10-1999ORDINANCE NO. 1374 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT FOR A PROFESSIONAL OFFICE ON A.J. HUITT SURVEY, ABSTRACT 709, TRACT 31, ALSO KNOWN AS 511 SOUTH EULESS MAIN STREET; PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on June 15, 1999, in conjunction with Specific Use Permit Case No. 99 -08 -SUP, and has rendered a recommendation to the City Council with respect to this case; WHEREAS, City Council has conducted a public hearing on August 10, 1999, has considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless and that any foreseeable negative impacts of the proposed use have been mitigated through design restrictions or other set conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,TEXAS: SECTION 1 ALLOWED USES THAT professional office uses as specifically described in this ordinance and on the Specific Use Permit Form (attached hereto and made a part hereof), shall be permitted on A.J. Huitt Survey, Abstract 709, Tract 3I, also known as 511 South Euless Main Street. SECTION 2 RESTRICTIONS THAT the exterior appearance of the building and yards shall be residential in nature, with the exception of a sign, parking, and other items specifically approved by Planned Development Ordinance No. 1367. No changes shall be made to the exterior architectural form of the building, including but not limited to expansion of the current building footprint, while this SUP is in effect. Furthermore, conditions on the attached list entitled "Conditions Attached to Ordinance No. 1374" must be met in order for this Specific Use Permit to remain effective. SECTION 3 EXPIRATION THAT this Specific Use Permit expires immediately upon commencement of residential use of the above property or two years after the issuance of the Certificate of Occupancy, as specified on the attached Specific Use Permit Form, whichever occurs first. SECTION 4 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 5 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the comprehensive zoning ordinance of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two - Thousand Dollars ($2,000) and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendment to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless, as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. SECTION 6 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
