AN ORDINANCE AMENDING CHAPTER 84 OF THE CODE OF
ORDINANCES, IDENTIFIED AS THE UNIFIED DEVELOPMENT CODE OF
THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING
DISTRICT MAP OF 183 ADDITION, BLOCK 1, LOT 3R FROM TX -10 (TEXAS
HIGHWAY TEN MULTI -USE DISTRICT) INTO PD #1375 (PLANNED
DEVELOPMENT NO. 1375), CONFORMING TO TX -10 ZONING DISTRICT
DEVELOPMENT STANDARDS, AND ALLOWING USES THAT ARE
ALLOWED BY RIGHT IN C -2 (COMMUNITY BUSINESS DISTRICT) ZONING
(THAT IS, ONLY THE C -2 USES THAT DO NOT REQUIRE A SPECIFIC USE
PERMIT), AND ALLOWING THE PAWN SHOP USE THAT IS ALLOWED IN 1 -1
(LIGHT INDUSTRIAL DISTRICT) ZONING; PROVIDING FOR A
SEVERABILITY CLAUSE, PENALTY FOR VIOLATION AND AN EFFECTIVE
DATE.
WHEREAS, the Planning & Zoning Commission has conducted a public hearing on July
20, 1999, in conjunction with Zoning Case No. #99- 04 -PD, and has rendered a
recommendation to the City Council with respect to this case,
WHEREAS, the City Council has conducted a public hearing on August 10, 1999,
considered the recommendation of the Planning & Zoning Commission, and has
determined that the proposed change is in the best interest of the general welfare of the
City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless, Texas, being a part of
Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district
classification Of 183 Addition, Block 1, Lot 3R is changed from TX -10 (Texas Highway
Ten Multi -Use District) into PD #1375 (Planned Development No. 1375), conforming to
TX -10 Zoning District development standards, and only allowing uses that are allowed
by right in C -2 (Community Business District) Zoning (that is, only the C -2 uses that do
not require a Specific Use Permit), and allowing the Pawn Shop use that is allowed in 1 -1
(Light Industrial District) Zoning. This property shall conform to TX -10 (Texas Highway
Ten Multi -Use District) development standards except as shown on Exhibit A (Site Plan)
or stipulated herein. Said property described above shall be subject to all the
safeguards and conditions set forth on said Site Plan or stipulated herein. Said Site Plan
shall be applicable only to the property described in herein.
SECTION 2
STIPULATIONS
THAT the property described herein shall conform to the following stipulations:
1. The three 900 square feet retail spaces shown on page 1 of 3 of the Site Plan be
limited to retail uses other than pawn shop
2. There shall be no connecting doors between the pawn shop and the other retail
operations.
3. The roof of the building as shown on page 1 of 3 of the Site Plan be a gabled roof,
the same as the existing gables on the other two buildings, as called out on sheet 1
of 3.
4. There shall be no more than one single monument sign out front for the building plus
one wall sign for each tenant above the entryway to each tenant.
5. All wall signs shall have the same size lettering.
SECTION 3
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council
of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of
this ordinance are severable and if any phrase, clause, sentence, paragraph, or section
of this ordinance shall be declared unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation in this
ordinance of any such unconstitutional phrase.
SECTION 4
PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and
provisions of this ordinance, or the amendments to the comprehensive zoning ordinance
of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon
conviction thereof, shall be liable to a fine in an amount not to exceed Two - Thousand
Dollars ($2,000) and each day such violation shall continue or be permitted to exist shall
constitute a separate offense. Any amendment to the general penalty provision found in
the comprehensive zoning ordinance of the City of Euless, as amended, shall be
deemed to automatically amend this penalty provision in conformity therewith.
SECTION 5
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its
passage, as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of
the Euless City Council on the 10th day of August, 1999, by a vote of 5 ayes, 2 nays,
and 0 abstentions.
