HomeMy WebLinkAbout1382 09-14-1999ORDINANCE NO. 1382 AN ORDINANCE AMENDING CHAPTER 84 OF THE CODE OF ORDINANCES, IDENTIFIED AS THE UNIFIED DEVELOPMENT CODE OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS ZONING DISTRICT MAP ON GEORGE LINNEY SURVEY, ABSTRACT 939, TRACT 1A, BY CHANGING THE ZONING FROM R -1 (SINGLE FAMILY DETACHED DWELLING DISTRICT) INTO PD #1382 (PLANNED DEVELOPMENT NO. 1382) CONFORMING TO R -11L (SINGLE FAMILY LIMITED DWELLING DISTRICT) ZONING EXCEPT AS DESCRIBED HEREIN AND ON THE ATTACHED EXHIBIT "A "; PROVIDING FOR A SEVERABILITY CLAUSE, PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on August 17, 1999, in conjunction with Zoning Case No. #99- 03 -PD, and has rendered a recommendation to the City Council with respect to this case; WHEREAS, the City Council has conducted a public hearing on September 14, 1999, considered the recommendation of the Planning & Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,TEXAS: SECTION 1 THAT the official zoning district map of the City of Euless, Texas, being a part of Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district classification of George Linney Survey, Abstract 939, Tract 1A, is changed from R -1 (Single Family Detached Dwelling District) into PD #1382 (Planned Development No. 1382 conforming to R-11- Single Family Limited Dwelling District Zoning Except As Described Herein and on the Attached Exhibit "A "). Said property described above shall be subject to all the safeguards and conditions set forth on said Exhibit "A" or stipulated herein. Said Exhibit "A" shall be applicable only to the property described in herein. SECTION 2 STIPULATIONS 1. All perimeter wood fences to be eight feet in height with metal posts. 2. The City of Euless engineering staff is hereby authorized to work with the developer, after receiving a hydraulic study, on what is best for the channel, using the Tipton Engineering letter sent July 2, 1999, as guidelines. (Said letter is attached hereto and made a part hereof.) 3. The brick fence shown on the elevation /landscape detail on said Exhibit "A" along Ash Lane shall be extended through Lot 4. 4. All above ground franchise utility appurtenances shall be located on the rear of all lots throughout the development. SECTION 3 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 4 PENALTY FOR VIOLATION. Any person, firm, or corporation violating the terms and provisions of this ordinance, or the amendments to the comprehensive zoning ordinance of the City of Euless hereby made, shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be liable to a fine in an amount not to exceed Two - Thousand Dollars ($2,000) and each day such violation shall continue or be permitted to exist shall constitute a separate offense. Any amendment to the general penalty provision found in the comprehensive zoning ordinance of the City of Euless, as amended, shall be deemed to automatically amend this penalty provision in conformity therewith. SECTION 5 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. Ector Drive Euless, TX 76039 -3595— RE: LAKEWOOD ADDITION EULESS, TEXAS TEI PROJECT NO. 4467 Dear Ms. Griffith: The following is a response to the June 22, 1999, Development Review Committee comments. BUILDING OFFICIAL: 1. The open space has been labeled as parcel "A ". 2. Per previous DRC comments, the title block and note number 2 have been changed to blocks 4 and 5. 3. The spacing of the "Landscape pocket" has been changed to the center of each lot adjacent to Ash Lane. 4. The rear yard setbacks have been changed to 10'. 5. The detail reflects the 4' sidewalk F off of the property line in the R.O.W. 6. The minimum F.F.E.'s are based on 2' of freeboard. PUBLIC WORKS: Per a draft letter from Andrea, which is included with this submittal, the following are our response comments. 1. The retaining wall along the R.O.W. of Lakeshore and Eastridge Drives and along the north line of the addition will be concrete, rock or masonry. These materials are noted on the Exhibit. Pedestrian and maintenance access will be provided from Lakeshore Drive. Wrought iron fence will be provided along the R.O.W. of LAKEWOOD ADDITI%..i COMMENTS JULY 2, 1999 PAGE open spaces if drop offs are greater than 2 vertical feet. The owner intends to maximize tree preservation in the open spaces. Remaining trees will have tree wells constructed around them, as necessary. 2. The flowline of the channel will be concrete or exposed rock. 3. Approval of improvements and tree removal in the open spaces will be coordinated as directed by the Asst. Director of Public Works. 4. The label has been changed to state " Gabion mattress or other erosion control device as directed by the Asst. Director of Public Works. 5. Clean up of the "Water Edge" at the north end will be coordinated as directed by the Asst. Director of Public Works. 6. Gabion baskets or concrete curbs will extend along the entire length of the channel. 7. The location of the pilot channel has been shown on the Exhibit. Check dams, and other features will be determined at the time of final plans. DEVELOPMENT OFFICE: 1. No comments. DEVELOPMENT OFFICE: No comments. FIRE DEPARTMENT: Per a phone conversation with Don Wilson, the current street names are acceptable. FIRE MARSHAL: U" L J 1. No comments. GIS DEPARTMENT: 1.
