AN ORDINANCE AMENDING CHAPTER 84 OF THE CODE OF
ORDINANCES, IDENTIFIED AS THE UNIFIED DEVELOPMENT CODE
OF THE CITY OF EULESS, TEXAS; AMENDING THE CITY OF EULESS
ZONING DISTRICT MAP ON S. TUCKER SURVEY, AB. 1512, TRACT
6D AND THE R. CROWLEY SURVEY, AB. 312, TRACT 2, BY
CHANGING THE ZONING FROM CUD 678 AND CUD 754 (CUD 678 =
COMMUNITY UNIT DEVELOPMENT FOR MULTI - FAMILY AT VARIOUS
DENSITIES AND C -2 COMMUNITY BUSINESS DISTRICT; CUD 754 =
COMMUNITY UNIT DEVELOPMENT FOR C -1 NEIGHBORHOOD
BUSINESS DISTRICT, C -2 COMMUNITY BUSINESS DISTRICT, MULTI-
FAMILY AT VARIOUS DENSITIES, AND 1 -1 LIGHT INDUSTRIAL
DISTRICT) INTO PD #1387 (PLANNED DEVELOPMENT NO. 1387)
CONFORMING TO PD (PLANNED DEVELOPMENT FOR MULTI-
FAMILY BASED ON R -3 MULTIPLE FAMILY LOW DENSITY
DWELLING DISTRICT) ZONING EXCEPT AS DESCRIBED HEREIN
AND ON THE ATTACHED EXHIBIT "A "; PROVIDING FOR A
SEVERABILITY CLAUSE, PENALTY FOR VIOLATION AND AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission has conducted a public hearing on
September 21, 1999, in conjunction with Zoning Case No. #99- 06 -PD, and has
rendered a recommendation to the City Council with respect to this case;
WHEREAS, the City Council has conducted a public hearing on October 26, 1999,
considered the recommendation of the Planning and Zoning Commission, and has
determined that the proposed change is in the best interest of the general welfare of the
City of Euless;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS:
SECTION 1
THAT the official zoning district map of the City of Euless, Texas, being a part of
Chapter 84 of the Code of Ordinances, be amended to read so that the zoning district
classification of S. Tucker Survey, Ab. 1512, Tract 6D and the R. Crowley Survey, Ab.
312, Tract 2, is changed from CUD 678 and CUD 754 (CUD 678 = Community Unit
Development for multi - family at various densities and C -2 Community Business District;
CUD 754 = Community Unit Development for C -1 Neighborhood Business District, C -2
Community Business District, multi - family at various densities, and 1 -1 Light Industrial
District) into PD #1387 (Planned Development No. 1387 conforming to PD Planned
Development for multi - family based on R -3 Multiple Family Low Density Dwelling
District Zoning Except As Described Herein and on the Attached Exhibit "A "). Said
property described above shall be subject to all the safeguards and conditions set forth
on said Exhibit "A" or stipulated herein. Said Exhibit "A" shall be applicable only to the
property described in herein.
This ordinance includes the acceptance that nine acres on the southeast is to be
deeded to the City. It also includes the condition that the fencing shall be as shown on
sheet 3 of the plans.
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council
of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of
this ordinance are severable and if any phrase, clause, sentence, paragraph, or section
of this ordinance shall be declared unconstitutional by the valid judgment or decree of
any court of competent jurisdiction, such unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation in this
ordinance of any such unconstitutional phrase.
SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms
and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon
conviction thereof shall be fined in accordance with Chapter "General Provisions," Section
1 -12 "General Penalty," Euless Code of Ordinances. Each such violation shall be
deemed a separate offense and shall be punishable as such hereunder.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its
passage, as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of
the Euless City Council on October 26, 1999, by a vote of 6 ayes, 0 nays, and 0
abstentions.

LEGAL DESCRIPTION
BEING 18.565 acres of land located in the R. CROWLEY SURVEY, Abstract No.
312, Tarrant County, Texas, and the S. TUCKER SURVEY, Abstract No. 1512,
Tarrant County, Texas, and being a portion of the tract of land described
in the deed to Sunbelt Savings Association of Texas, recorded in Volume
9087, Page 2039 of the Deed Records, Tarrant County, Texas. Said 18.565
acres of land being more particularly described by metes and bounds, as
follows:
BEGINNING at an "X" in concreteat the most Westerly Southwest corner of
Hill Trail Drive, according to the Right -of -way Dedication Plat of Hill
Trail Drive, to the City of Euless, Tarrant County, Texas, as recorded in
Volume 388 -181, Page 90, of the Plat Records, Tarrant County, Texas, said
point lying S 00° 06' 34" E 175.67 feet, and S 89° 59' 32" E 5.04 feet
from the Northwest corner of said Sunbelt Tract;
THENCE along "he Southerly right -of -way line of said Hill Trail Drive,
as follows:
1. S 89° 59' 32" E 78.10 feet to a 1/2" iron rod at the
beginning of a curve to the Right;
2. SOUTHEASTERLY 418.69 feet along said curve to the Right,
having a radius of 350.00 feet, a central angle of 680 32' 48"
and a chord bearing S 550 43' 10" E 394.18 feet to a 1/2" iron
rod;
3. S 21' 26' 31" E 381.49 feet to a 1/2" iron rod at the
beginning of a curve to the Left;
4. EASTERLY 492.85 feet along said curve, having a
radius of 275.00 feet, a central angle of 1020 41' 03" and a
chord bearing S 72° 47' 03" E 429.49 feet to a 1/2" iron rod;
5. N 55° 52' 25" E 192.09 feet to a 1/2" iron rod at the
intersection of the Westerly right -of -way line of Bear Creek
Parkway, according to the Right -of -way Dedication Plat of Bear
Creek Parkway, to the City of Euless, Tarrant County, Texas, as
recorded in Volume 388 -181, Page 89 of the Plat Records of
Tarrant County, Texas;
THENCE along said Westerly right -of -way line, as follows:
SOUTHEASTERLY 423.73 feet along a curve to the Left,
having a radius of 725.00 feet, a central angle of 330 29' 11"
and a chord bearing S 500 25' 57" E 417.72 feet to a 1/2" iron
rod at the beginning of a curve to the Right;
SOUTHEASTERLY 347.17 feet along said curve, having a
radius of 275.00 feet, a central angle of 720 19' 58" and a
chord bearing S 31° 00' 48" E 324.57 feet to a 1/2" iron rod
lying in the North line of a tract, of land described in the
Quit Claim from Sunbelt Savings to the City of Euless, Tarrant
County, Texas, recorded in Volume 9867, Page 1954, Deed Records
of Tarrant County, Texas;
THENCE along said North line of said City of Euless Tract, as follows:
N 710 35'.18" W 317.66 feet to a 1/2" iron rod;
S 83° 01' 28" W 665.71 feet to a 1/2" iron rod;
N 70° 38' 23" W 390.26 feet to a 1/2" iron rod;
N 610 53' 27" W 305.84 feet to a 1/2" iron rod lying in the
East right -of -way line of Fuller -Wiser Road, according to the
Right -of -way Dedication Plat of Fuller -Wiser Road to the City
of Euless, Tarrant County, Texas, as recorded in Volume 388-
181, Page 92 of the Plat Records of Tarrant County, Texas;
THENCE N 000 06' 34" W 847.77 feet along said East right -of -way
line to THE PLACE OF BEGINNING, containing 18.565 acres (808,676
square feet) of land.
