AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE
PERMIT ON TERRELL JASPER SURVEY, AB. 861, PORTIONS OF
TRACT 5A2A AND TRACT 5A2 FOR AUTOMOTIVE GENERAL REPAIR
AND AUTOMOTIVE PAINT AND BODY REPAIR; PROVIDING FOR A
SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN
EFFECTIVE DATE.
WHEREAS, the Planning and Zoning Commission has conducted a public hearing on
September 21, 1999, in conjunction with Specific Use Permit Case No. 99 -10 -SUP, and
has rendered a recommendation to the City Council with respect to this case;
WHEREAS, City Council has conducted a public hearing on October 26, 1999, has
considered the recommendation of the Planning and Zoning Commission, and has
determined that the proposed change is in the best interest of the general welfare of the
City of Euless and that any foreseeable negative impacts of the proposed use have been
mitigated through design restrictions or other set conditions,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS,TEXAS:
SECTION 1
ALLOWED USES
THAT automotive general repair and automotive paint and body repair uses as
specifically described on Exhibit "A" Final Site Plan (case # 99 -10 -SP attached hereto and
made a part hereof) and on the Specific Use Permit Form (attached hereto and made a
part hereof), shall be permitted on Terrell Jasper Survey, Ab. 861, portions of Tract 5A2A
and Tract 5A2.
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of
the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this
ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this
ordinance shall be declared unconstitutional by the valid judgment or decree of any court
of competent jurisdiction, such unconstitutionality shall not affect any of the remaining
phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this ordinance
of any such unconstitutional phrase.
SECTION 3
PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms
and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon
conviction thereof shall be fined in accordance with Chapter "General Provisions," Section
1 -12 "General Penalty," Euless Code of Ordinances. Each such violation shall be
deemed a separate offense and shall be punishable as such hereunder.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its
passage, as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of
the Euless City Council on October 26, 1999, by a vote of 6 ayes, 0 nays, and 0
abstentions.

PROPERTY DESCRIPTION
BEING a description of a 2.517 acre or 109,647 square foot tract of land situated in the TERRELL
JASPER SURVEY ABSTRACT NUIv[BER 861, in the Cite of Euless, Tarrant County, Texas, and
being a portion of that same tract of land as conveyed to A.S. Patel and described in a Special
Warranty Deed with Vendors Lien recorded in Volume 13037 at Page 356 of the Deed Records of
Tarrant County, Texas. said 2.517 acre tract being more particularly described by metes and bounds
as follows;
BEGINNING at a 1/2 -inch steel rod with a red plastic cap stamped 'Prism Surveys" set for comer
at the northeast comer of Lot 1 in Block 1 of Farr- Pacific Addition, an addition to the City of
Euless as shown on the Plat recorded in Volume 388 -168 at Pave 16 of the Plat Records of Tarrant
County, Texas. Said steel rod being on the south right -of -way line of State Highwav No. 183, (by
deed, a distance of 177.44 feet perpendicular distance from the centerline thereof), and also the
northwest corner of said Patel tract;
THENCE North 89 deg. 42 min. 00 sec. East, departing said Farr - Pacific Addition, and along the
south right -of -way line of said State Highway No. 183 and the north line of said Patel tract, a
distance of 170.00 feet to a 1/2-inch steel rod with a red plastic cap stamped 'Prism Surveys"
set for comer;
THENCE South 00 deg. 41 min. 53 sec. East, departing the said south right -of -way line of State
Highway No. 183, a distance of 645.00 feet to a 1/2 -inch steel rod with a red plastic cap stamped
"Prism Surveys" set for corner;
THENCE South 89 deg. 42 m n. 00 sec. West, a distance of 170.00 feet, to a 1/2 -inch steel rod with
a red plastic cap stamped 'Prism Surveys" set for corner;
THENCE North 00 deg. 41 min. 53 sec. West, along the east line of said addition, a distance of
645.00 feet to the POINT OF BEGINNING;
and containing a computed acreage of 2.517 acres or 109,647 square feet of land, more or less.
Basis of Bearings: The Basis of Bearings for this survey is the north line of that same 15.051 acre
tract of land conveved to A.S. Patel and described in a Deed recorded in Volume 12426 at Page
1484 of the Deed Records of Tarrant County, Texas.
