AN ORDINANCE AMENDING CHAPTER 30, "FEES," SECTION 30-
28(1), "LIBRARY MATERIALS AND FACILITIES," SECTION 3034,
"WATER DEPOSITS," SECTION 3036, "WATER AND SEWER
SERVICE MONTHLY RATES," SECTION 30 -36, "SAME —
RECONNECTION," AND SECTION 3038, "MISCELLANEOUS FEES,"
OF THE EULESS CODE OF ORDINANCES; PROVIDING A SAVING
CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING
AN EFFECTIVE DATE
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL, CITY OF EULESS, TEXAS:
SECTION 1
That Chapter 30, "Fees ", Section 30- 28(1), "Library materials and facilities', is amended to read as follows:
(1) The following fees are established for use or misuse of library materials and facilities:

card and must present both punch card and library card). $0.25 per item
Fees are waived for students attending public schools in Euless while residing in the City of Fort Worth, and
for their families and for teachers of schools in Euless.
SECTION 2
That Chapter 30, "Fees ", Section 30 -34, "Water Deposits," is amended to read as follows:
See. 30-34. Water deposits.
If the deposit is paid or transfer of service received before noon, service can be connected that same
afternoon. If the deposit is paid or transfer of service received after noon, service can be connected the
following working day. If the customer requests service that afternoon, a same day service fee will be
charged. No specific times can be designated for water service connection other than four -hour
increments (8:00 a.m. to 12:00 noon, 1:00 p.m. to 5:00 p.m.) In addition to the water deposit, a service
initiation fee will be charged to establish a new account.

Deposit per unit for commercial customers shall not be less than $75.00 and shall be calculated
to equal the multiple of $5.00 nearest the estimated average monthly billing for the particular type
of customer involved. Calculation shall be based on water, sewer and garbage monthly billing.

If the amount of the security deposit exceeds one thousand dollars ($1,000.00), the requirement
for the security deposit may be met by providing a surety bond which shall be in the amount of
the deposit otherwise required. Such surety bonds shall be subject to the approval of the city
attorney and shall be supported by powers of attorney as he may direct. In addition to any
requirements of the city attorney, such surety company shall be licensed to do business in the
State of Texas and shall be "T- listed."

All customers are allowed one recheck every six months at no charge; a charge will be assessed
for all others unless the meter has been misread.

That Chapter 30, "Fees ", Section 30 -35, "Water and sewer service— Monthly rates" is amended to read as
follows:
Sec. 30-36. Water and sewer service -- Monthly rates.
The schedule of monthly rates and charges for water and sewer services furnished or caused to be
furnished by the city is as follows:
Water service— Residential
The monthly minimum per living unit shall be as follows:
(1) within corporate limits.... $7.00 plus $2.34 per 1,000 gallons
(2) outside corporate limits.... $10.00 plus $2.34 per 1,000 gallons
Water service — Commercial and Industrial
(1) within corporate limits.... $7.00 plus $2.34 per 1,000 gallons
(2) outside corporate limits.... $10.00 plus $2.34 per 1,000 gallons
Sewer service — Residential. The sewer service charge for residential customers shall be based on 90
percent of metered water. Sewer service charges on 90 percent metered water shall not exceed 12,000
gallons per billing period per living unit. The monthly minimum per living unit shall be as follows:
(1) Within corporate limits, $5.20 plus $1.39 per 1,000 gallons of 90 percent of metered water.
(2) Outside corporate limits, $10.00 plus $1.39 per 1,000 gallons of 90 percent of metered water.

Sewer service -- Commercial and industrial. Commercial and industrial sewer charges shall be based on
100 percent of metered water. The rates are monthly minimum within city limits, $5.20 plus $1.39 per
1,000 gallons; monthly minimum outside city limits, $10.00 plus $1.39 per 1,000 gallons of metered water.
The following provisions apply to all commercial and industrial customers:
(1) Customers who show proof that a significant portion of metered water does not enter the sanitary
sewer shall not be billed for that portion that does not enter sanitary sewer.
(2) Monitored group class customers shall be billed according to section 86 -51 of this Code.
(3) Industrial cost recovery group customers shall be billed according to section 86 -51 of this Code
plus the additional charges in section 86 -52 as required.
Water service - -Other. Water service for municipally owned property and buildings that are part of or
connected to form a parcel of at least a minimum of 50 acres shall be $0.50 per 1,000 gallons.
Sewer service- - Other. Sewer service for all club houses, convention facilities, and restaurants on
municipally owned property of a minimum of 50 acres shall be billed at the current city rates of $5.20 plus
$1.39 per 1,000 gallons of water used.
The above rates are based on the cost of treated water purchased by the city from the Trinity
River Authority of Texas. As the cost of treated water purchased by the city from the Trinity River
Authority of Texas increases from time to time, the charge per 1,000 gallons' usage shall be
increased by a like amount effective concurrent with such increased charge to the city. The
minimum charge and /or usage charge may be further adjusted by the city council from time to
time.
Master deposit. Customers may put up a master deposit in the amount of twice the current residential
deposit. This deposit will be held on file until the customer wishes it to be refunded. Customers must
request service starts and disconnects in writing. All accounts will be charged the current service initiation
fees plus sanitation fees in advance on the first billing. No master deposits are allowed on commercial
accounts.
That Chapter 30, "Fees ", Section 30 -36, "Same— Reconnection ", be deleted in its entirety.

That Chapter 30, "Fees," Section 30 -38, "Miscellaneous fees," be amended to read as follows:

SAVING CLAUSE. That applicable chapters of the Code of Ordinances, City of Euless, Texas, as amended,
shall remain in full force and effect, save and except as amended by this ordinance.
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections,
paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause,
sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid
judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or
unconstitutional phrase, clause, sentence, paragraph or section.
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and
publication as provided by the Euless City Charter and the laws of the State of Texas.

1999, at a regular meeting of the City Council of the City of Euless, Texas, by a vote of 6 ayes, 0 nays
