HomeMy WebLinkAbout1414 04-11-2000ORDINANCE NO. 1414 AN ORDINANCE AMENDING CHAPTER 82 "TRAFFIC AND MOTOR VEHICLES," ARTICLE III "OPERATION OF VEHICLE, " SECTION 82 -63 "SAME - SCHOOL ZONES, " TO ESTABLISH A SCHOOL ZONE FOR CERTAIN AREAS; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING A SEVERABILIT %-' CLAUSE PROVIDING A SAVING CLAUSE, AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Euless desires to provide for traffic safety adjacent to school locations, and 0NHEREAS, the City of Euless desires to establish an additional school zone upon streets serving as access streets for pedestrian crossings of children attending Lakewood Elementary School; NOW, THEREFORE, BE IT ORDAINED BY THE CiTY COUh1 1L Olr THE Cl a Y OF EULESS, TEXAS: that Chapter 82 "Traffic and Motor Vehicles," Article III "Operation of Vehicle," Section 82 -63 "Same - School zones," be hereby amended as follows: Section i. Ardiand Sec. 82-63. (b)(2) entifled "Lakewoodl Ellemenumry School Zone. " By the addition of the following new subparagraph (e) to be and read as follows= (2) Lall(ewood Ellernenhwy School Zone: e. On Donley Drive at or near the north right -of -way line of ,ash Lane for northbound traffic and on Bocowood Drive at or near the west right -of -way line of Lakewood Boulevard for westbound traffic, and as so amended Section 82 -63. (b)(2) remains in effect. Section 11. Penalty for Vioiatiorn. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in accordance with Chapter 1, Section 1 -12, Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. Section ill. Severability Clause. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses, and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or sentence. Section IV. Saving Ciause. That Chapter 82 of the Code of Ordinances, City of Euless, Texas, as amended, shall be in full force and effect, except as expressly amended hereby. Section V. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication by the Euless City Charter and the laws of the State of Texas PRESENTED AND GIVEN FIRST AND FINAL READING AND APPROVED at a regular meeting of the Euless City Council on the 11th day of April, 2000, by a vote of 7 ayes, 0 nays, and 0 abstentions.
