HomeMy WebLinkAbout1436 06-27-2000ORDINANCE NO. 1436 AN ORDINANCE AUTHORIZING THE ISSUANCE OF A SPECIFIC USE PERMIT ON WHILSHIRE VILLAGE SHOPPING CENTER, TRACTS A, B. AND C, FOR A CHURCH; PROVIDING FOR A SEVERABILITY CLAUSE; PENALTY FOR VIOLATION AND AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission has conducted a public hearing on June 6, 2000, in conjunction with Specific Use Permit Case No. 00 -06 -SUP, and has rendered a recommendation to the City Council with respect to this case; 11VHEREAS, City Council has conducted a public hearing on June 27, 2000, has considered the recommendation of the Planning and Zoning Commission, and has determined that the proposed change is in the best interest of the general welfare of the City of Euless and that any foreseeable negative impacts of the proposed use have been mitigated through design restrictions or other set conditions; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 ALLOWED USES THAT church uses as described on Exhibit "A" (attached hereto and made a part hereof} and on the Specific Use Permit Form (attached hereto and made a part hereof), shall be permitted on Wilshire Village Shopping Center, Tracts A, B, and C. SECTION 2 SEVERAEILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 PENALTY FOR VIOLATION. Any person, firm, or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined in accordance with Chapter "General Provisions," Section 1 -12 "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 4. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. Euless Boulevard (legal description): Wilshire Village Shopping Center, Tracts A, B, and C This permit is valid only for the property and use listed above and then ONLY in accordance with the following documents and /or conditions: DOCUMENTS: Specific Use Ordinance No. 1436 CONDITIONS: (1) Limited to a 3 -year term; (2) Bldg. #3 be removed from the request and remain under the TX -10 zoning with the requrted parking spaces; (3) Buildings within the SUP exclude retail and wholesale uses with the exception to allow the postal service to finish out their current lease and then be requited to move into a building not in the SUP; (4) The old Bonanza restaurant building (Building #4) west of Building #3 be brought into the same exterior facade as Buildings ill, 1i2, and #3; (5) Limited to Restoration Church congregation; (6) The fence be removed on the north side of the property; and (7) Construction be completed within one year. Harp DATE: April 30, 2000 The following are the disposition of comments in numerical order and by department category for the above referenced case # following the DRC's second review of the exhibit: BUILDING OFFICIAL 1. A list of church related uses and corresponding square footage and anticipated use including days and hours of operations are as follows: A. Building #1 as shown on the exhibit beginning at the east end and moving west: 1. Space 94 — Worship Center — 22,000 square feet — used for large congregational gatherings each Sunday from 10 A.M. to Noon. Used for special conferences and events intermittently throughout the year. 2. Space 90 — 6,000 square feet — unfinished space currently used for storage and reserved for possible expansion of the Worship Center. 3. Spaces 88 & 90 — 4,600 square feet — currently used as the Care Ministry, a food ministry outreach to the poor in the community. Although volunteers work in this area Monday through Thursday from 11 A-M. to 6 P.M. repackaging foods, the hours this ministry is open to the public are Tuesdays and Thursdays from 2:30 P.M. to 6 P.M. 4. Spaces 84 & 86 — 4,600 square feet are currently used as space for the church offices. Office hours are Monday through Friday from 9 A.M. to 4 P.M. 5. Space 82 — 7,400 square feet — this area is used as the church nursery and is primarily used on Sunday mornings from 9 A.M. until Noon plus occasional special events during the year. 6. Space 80 — 8,600 square feet — this area is currently used weekly for various smaller congregational gatherings. The area also includes the church kitchen. 7. Space 78 — 11,350 square feet — this area is currently used for Children's Ministry and contains smaller classrooms of various sizes. The area is used primarily on. Sundays from 9 A.M. until Noon. 8. Space 76 — 6,000 square feet — this area is currently used as our Youth Center and is occupied primarily on Sunday mornings from 9 A.M. until Noon and on Sunday evenings from 5:30 Exhibit B, Ordinance No.1436, Page 6 of 4 7 P.M. until 8:30 P.M. During the year 2000, this area will be annexed by the Children's Ministry. 9. Spaces 70 & 74 — 8,000 square feet — currently vacant, this area will be finished out to code compliance during the year 2000 to be used as a new Youth Center. 10. Space 68 — 6,600 square feet — currently vacant, the probable future use of this space will be the new office suite for the church. Timing of this is indefinite at this time. When completed, the existing office suite will be annexed by the Nursery Ministry. 11, Space 66 — 3,300 square feet — currently vacant, this space will be finished out to code compliance during the year 2000 and used as the headquarters of a separate non - profit ministry, the Fellowship of Connected Churches and Ministries, Inc. 12. Space 64 — 2,200 square feet — vacant; will be used only for equipment storage for the foreseeable future. B. Building #2 as shown on the exhibit beginning on the south and moving north. 1. Space 10 — 15,385 square feet —this old grocery store is currently vacant, but is the probable site for relocation of our Care Ministry discussed in item A -3 above. The timing of the relocation is indefinite at this time. 2. Space 12 — 2,700 square feet — currently under lease to the U.S. Postal Service. The lease expires in 2002, but the Postal Service has a 5 year option beyond that date. 3. Spaces 14 through 32 — 22,815 square feet currently vacant — these areas will probably be leased out after building #2 is rehabilitated and /or converted to use by various "storefront" ministries (legal aid, medical aid, etc.) C. Building #3 — 7,600 square feet will continue to be used as Ieased retail space for the foreseeable future. D. Building 94 — to be razed as per the Table of Improvements E. Old restaurant building — 2,500 square feet — will continue to be used as a Hispanic Church through May, 2001, then will be used as a special use facility by the church (chapel, prayer center, etc.) PUBLIC WORKS / ENGINEERING 1. Since our parking lot only has a large volume of traffic on one day per week (Sunday) with minimal traffic volume all other days except for infrequent special events, we are proposing the following relative to the fire lanes and parking lot: The current fire lanes and parking lot will be overlaid with a new 2 inch surface of asphalt and restriped. Any deteriorated areas (of which there are approximately thirteen, all small except for a larger area behind building #2) will be taken down to soil level with the base rebuilt to 6 inches and then 4 new inches of asphalt added. Our development firm, Innovative Developers, Inc., have assured us that Exhibit B, Ordinance No. 1436 Page 7 of A-7
