HomeMy WebLinkAbout1465 03-14-2001ORDINANCE NO. 1465 AN ORDINANCE PROVIDING A SIXTY (60) DAY MORATORIUM ON THE PERMITTING OF POLE SIGNS FOR PROPERTY ABUTTING MAIN STREET BETWEEN THE CENTER LINES OF SOUTH PIPELINE ROAD AND GLADE ROAD; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS the City Council of the City of Euless intends to call for public hearings on a proposed change to the Euless Unified Development Code to prohibit pole signs for properties abutting a portion of Main Street, and WHEREAS the City Council desires to establish a moratorium on the permitting of pole signs within such area pending such public hearings and the decision of the City Council as to whether to amend the Euless Unified Development Code to proscribe such signage within such area of Main Street. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 For a period of sixty (60) days from the effective date hereof, unless sooner terminated or further extended, the City of Euless imposes a moratorium on the acceptance of applications or the issuance of permits for any pole signs on property abutting Main Street between the centerlines of South Pipeline Road and Glade Road. It is the express intent of this Ordinance, however, to allow applications for pole signs within such area, currently in progress, to proceed unaffected hereby, but to prohibit the acceptance of applications or issuance of permits for any other pole signs within such area until the expiration of this moratorium. SECTION Z SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 3 SAVINGS CLAUSE. Chapter 84 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
