HomeMy WebLinkAbout1478 06-26-2001ORDINANCE N0. 1478 AN ORDINANCE AMENDING CHAPTER 30, "FEES," AMENDING SECTION 30 -15, "FIRE PREVENTION CODE "; AMENDING SECTION 30 -16, "SOLID WASTE COLLECTION'; AMENDING SECTION 30 -34, "WATER DEPOSITS "; AMENDING SECTION 30 -35, "WATER AND SEWER SERVICE — MONTHLY RATES; ADDING NEW SECTION 30- 36, "PRIVATE WATER WELL PERMIT FEE "; AMENDING SECTION 30- 38, "MISCELLANEOUS FEES "; AND AMENDING SECTION 30-40, "SUBDIVISIONS ", OF THE CODE OF ORDINANCES OF THE CITY OF EULESS; TO REVISE THE FEES LISTED IN SAID SECTIONS; PROVIDING FOR A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Euless, Texas, after study, finds that certain fees contained in the current fee structure do not provide adequate reimbursement to the City of Euless for the goods and services furnished in return for such fees; and WHEREAS, the City Council further finds that the fees contained in this ordinance provide such adequate reimbursement; NOW, THEREFORE, BE IT ORDAINED, by the City Council of the City of Euless, Texas: SECTION 1 THAT Section 30 -15, "Fire Prevention Code," of Chapter 30, "Fees ", of the Code of Ordinances, be hereby amended, and the amended section shall hereafter be and read in its entirety as follows: Section 30 -15. Fire Prevention Code. (kkk) Contractors registration fee, annual 50.00 (III) Contractors renewal fee (January) 25.00 (mmm) Expired permit penalty late fee 25.00 (nnn) After hours fire inspection, per hour 47.00 (000) Private agency request for a fire safety inspection to secure certification or license 40.00 SECTION 2 THAT Section 30 -16, "Solid Waste Collection ", of Chapter 30, "Fees ", of the Euless Code of Ordinances, as amended, be hereby amended with the addition of the recycling rates franchise fee, which the amended category shall hereafter be and read as follows: Recycling rates: Franchise fees .... 5% of residential billings excluding apartment units .... $0.45 per apartment unit SECTION 3 THAT Section 30 -34, 'Water Deposits ", of Chapter 30, "Fees ", of the Euless Code of Ordinances, as amended, be hereby amended, and the amended section shall hereafter be and read in its entirety as follows: Ordinance No. 1478, Page 5 of 9 If the deposit is paid or the request for transfer of service is received before noon, service can be connected that same day. If the deposit is paid or transfer of service received after noon, service can be connected the following working day. No specific times can be designated other than four -hour increments (8:00 a.m. to 12:00 noon, 1:00 p.m. -5:00 p.m.). If the customer requires service be turned on immediately, a same day service fee will be charged. In addition to the water deposit, a service initiation fee will be charged to establish a new account. Calculation shall be based on water, sewer and garbage monthly billing. If the amount of the security deposit exceeds $1,000.00, the requirement for the security deposit may be met by providing a surety bond, which shall be in the amount of the deposit otherwise required. Such surety bonds shall be subject to the approval of the city attorney and shall be supported by powers of attorney as he may direct. In addition to any requirements of the city attorney, such surety company shall be licensed to do business in the State of Texas and shall be "T- listed." Emergency cut -off by city personnel (broken pipes or freeze damaged pipes) No charge Cut -off for plumbing repairs No charge The curbstop at the meter belongs to the city; all customers should have a working cutoff close to their house. (No additional deposit, no reconnect fee.) Reconnection of service after delinquent turnoff: Additional deposit 20.00 Service charge 20.00 SECTION 4 THAT Section 30 -35, "Water and Sewer Service — Monthly Rates," of Chapter 30 "Fees" of the Euless Code of Ordinances, as amended, be amended by adding the following item to Water Service — Commercial and Industrial: Water Service — Commercial and Industrial (3) Supplemental Irrigation $3.51 per 1,000 gallons SECTION 5 THAT Section 30 -36, "Private Water Well Permit Fee," of Chapter 30 "Fees" of the Euless Code of Ordinances, be added which when added shall hereafter be and read as follows: Proposed well depth in feet 500 and less 501 -1,000 1,000 and greater This fee would include all plan review and inspection labor. Electrical Permit fees will also apply. See Sec. 30 -10. Ordinance No. 1478, Page 8 of 9 Fee $ 500.00 1,000.00 1,500.00 SECTION 6 THAT Section 30 -38, "Miscellaneous Fees ", of Chapter 30, "Fees ", of the Code of Ordinances be amended by amending the following charge to read as follows: Unified Development Code (UDC) SECTION 7 $30.00 THAT Section 30-40, "Subdivisions ", of Chapter 30, "Fees ", of the Code of Ordinances, be amended by adding the following charge to read as follows: Public Works water main bacteriological testing — the first test will $50.00 be provided at no charge; second and subsequent retest each sample SECTION 8 SAVING CLAUSE. That applicable chapters of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas.
