HomeMy WebLinkAbout149 06-13-1961ORDINANCE NO, 149 AN ORDINANCE TO PROMOTE PUBLIC SAFETY BY ESTABLISH- ING MANDATORY TRUCK ROUTES WITHIN THE CORPORATE LIMITS OF THE CITY OF EULESS; CONTAINING CERTAIN DEFINITIONS; DESIGNATING CERTAIN STREETS, HIGHWAYS AND THOROUGHFARES AS MANDATORY TRUCK ROUTES, PRO- HIBITING TRUCK TRAFFIC ON OTHER THAN PRESCRIBED TRUCK ROUTES; PROVIDING CERTAIN EXCEPTIONS; GRANTING TO THE CHIEF OF POLICE OF THE CITY OF EULESS, TEXAS, POWER AND AUTHORITY TO ESTABLISH AND DESIGNATE CERTAIN TRUCK ROUTES UNDER EMERGENCY CONDITIONS; CONTAINING A SAVINGS CLAUSE; PROVIDING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE BY FINE OF NOT MORE THAN $200.00, AND PROVIDING THAT EACH DAY OF VIOLATION CONSTITUTE A SEPARATE OFFENSE; AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE City Council of the City of Euless, I. This Ordinance shall be known as the Truck Route Ordinance. II. Definitions: 1) Truck: For the purposes of this Ordinance, a truck shall be defined as a carrier motor vehicle with a gross weight load in excess of 6,500 pounds, designed, used and /or maintained primarily for transportation of property and which shall be held to include, but not limited to, trailers, truck tractors, cement mixing trucks and all dual- wheeled vehicles. 2) Trailer: Every vehicle, with or without motor power, designed for carrying persons or property and for being drawn by a motor vehicle. 3) Truck Tractor: Every motor vehicle designed and used primarily for drawing other vehicles and not so constructed as to carry a load other than a part of the weight of the vehicle and load so drawn. 4) Authorized Emergency Vehicles: Vehicles of the Fire Department, Police Department vehicles, public and private ambulances and other municipally -owned motor vehicles. III. The following streets, highways and thoroughfares in the Corporate Limits of the City of Euless, Tarrant County, Texas, shall be mandatory truck routes: State Highway No. 183 F -M Highway No. 157 Main Street Huffman Drive Harwood Road Pipe Line Road West from State Highway No. 183 to Euless West City Limits. IV. Truck traffic, as defined in this Ordinance, is prohibited on all streets in the City of Euless, Tarrant County, Texas, except on designated truck routes. V. Authorized emergency vehicles as defined in this Ordinance shall not be restricted to designated truck routes. VI. The Chief of Police of the City of Euless, Tarrant County, Texas, shall have the power and authority to establish and designate certain mandatory truck routes under emergency conditions. VII. Every section of this Ordinance and every provision of each section is hereby declared to be an individual section or provision and the holding of any section or provision of any section to be void, ineffective, or unconstitutional for any cause whatever shall not be deemed to affect any other section or provision hereof. VIII. All prior Ordinances or parts of such Ordinances in con- flirt herewith shall be and they are hereby repealed. IX. Any person violating any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon con- viction thereof shall be fined in any sum not more than $200.00. Each day a violation under this Ordinance continues shall con- stitute a separate and distinct offense. X. This Ordinance shall take effect and be in full force and effect from and after the date of its passage and publication as required by law. ADOPTED this of June, 1961.
