HomeMy WebLinkAbout1506 11-13-2001ORDINANCE NO. 1506 AN ORDINANCE AMENDING CHAPTER 30 "FEES" OF THE "CODE OF ORDINANCES" OF THE CITY OF EULESS BY DELETING SECTION 30 -10 "ELECTRICAL PERMITS, ETC." AND AMENDING SECTION 30 -13 "SCHEDULE OF BUILDING FEES "; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Euless has operated on the same fee schedule since its adoption in 1989; and WHEREAS, said fees do not allow the City to recover its costs for providing the services for which such fees are charged; and WHEREAS, the updated fees listed herein more closely represent the cost of said services, thereby placing the burden on the party benefiting from said services, rather than the taxpayers in general. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 Section 30 -10 "Electrical Permits, Etc." of Chapter 30 "Fees" of the Code of Ordinances be deleted in its entirety. SECTION 2 Section 30 -13 "Building Fees" of Chapter 30 "Fees" of the Code of Ordinances for the City of Euless, as amended, be amended to read in its entirety as follows: Sec. 30 -13 Building Fees. (a) Residential single family, two- family, town home family is based on $68.00 per square foot, and multifamily is based on $72.00 per square foot. Combination permit fees Total valuation Fee $1.00 to $500.00 $40.00 $501.00 to $2,000.00 $40.00 for the first $500.00 plus $3.25 for each additional $100.00 or fraction thereof. $2,001.00 to $25,000.00 $88.00 for the first $2000.00 plus $15.00 for each additional $1000.00 or fraction thereof. $25,001.00 to $50,000.00 $433.00 for the first $25,000.00 plus $3.25 for each additional $1000.00 or fraction thereof. $50,001.00 to $100,000.00 $649.00 for the first $50,000.00 plus $6.50 for each additional $1000.00 or fraction thereof. $100,001.00 to $500,000.00 $973.00 for the first $100,000.00 plus $2.00 for each additional $1000.00 or fraction thereof. $500,001.00 to $1,000,000.00 $1773.00 for the first $500,000.00 plus $1.50 for each additional $1,000.00 or fraction thereof. $1,000,001.00 and up $2600.00 for the first $1,000,000.00 plus $1.50 for each additional $1,000.00 or fraction thereof. (c) Plan review fees for all projects except residential shall be subject to 65% of the computed Building Permit Fee. Plan review fees are due at time of submittal. (d) Miscellaneous permit fees based on total cost of construction: Total valuation Fee $1.00 to $500.00 $30.00 $501.00 to $2,000.00 $30.00 for the first $500.00 plus $3.05 for each additional $100.00 or fraction thereof. $2,001.00 to $25,000.00 $69.25 for the first $2,000.00 plus $14.00 for each additional $1,000.00 or fraction thereof. $25,001.00 to $50,000.00 $391.25 for the first $25,000.00 plus $10.10 for each additional $1,000.00 or fraction thereof. $50,001.00 to $100,000.00 $643.75 for the first $50,000.00 plus $7.00 for each additional $1,000.00 or fraction thereof. SECTION 3 SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4 SAVING CLAUSE. That Chapters 30 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 13th day of November, 2001, by a vote of 7 ayes, 0 nays, and 0 abstentions.
