AN ORDINANCE AMENDING THE ORDINANCE NO. 33, KNOWN AS THE
TEMPORARY ZONING ORDINANCE OF THE EULESS, TEXAS, BY ADD-
ING CERTAIN DEFINITIONS, BY PROVIDING DUPLEX AND APARTMENT
USE DISTRICTS AND REGULATING SIZE, LOT COVERAGE AND FRONT-
AGE OF BUILDINGS SO ERECTED IN DUPLEX AND APARTMENT USE
DISTRICTS,
WHEREAS, the City of Euless, Tarrant County, Texas, has experienced
rapid population growth and expansion and such population growth and ex-
pansion appear likely to continue; and
WHEREAS, there has been an increasing number of requests to the
City Council that the City of Euless amend its Temporary Zoning Ordinance
No. 33 to provide for duplex and apartment dwelling use districts; and
WHEREAS, the Planning and Zoning Commission of the City of Euless,
Texas, has by resolution proposed the amendment of Temporary zoning Ordi-
nance No, 33 to provide for multiple family zoning use classifications; and
WHEREAS, after due consideration, study and public hearing as pro-
vided by law, at which public hearing all residents and parties of interest
were given an opportunity to be heard, the City Council of Euless, Texas,
does hereby amend Ordinance No. 33 known as the Temporary Zoning Ordinance of
Euless, as follows:
IT IS ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
I,
That Section I of Zoning Ordinance No. 33, styled "Definitions"
be amended by the addition of the following definitions:
Duplex: A two - family dwelling unit
Apartment: A building or portion thereof, arranged,
designed or occupied by three or more families living independently
of each other.
II.
That Section III of the Zoning Ordinance No, 33, styled "Districts"
be amended to read as follows:
"For the purpose of regulating and restricting the use of land and the
erection, construction, re- construction, alteration or use of buildings,
structures or land, the City of Euless is hereby divided into districts as
follows:
District A. Single - Family Dwelling Units
District A -2. Duplex: Two - Family Dwelling Units
District A -3: Apartment: Three of more Family Dwelling Units
District B. Local Business District
District C. Commercial

That Zoning Ordinance No. 33 be amended by the addition of Section
VII -A. as follows:
"In Duplex or Two - Family Dwelling Districts, no building, structure,
land or premises shall be used and no building or structure shall be hereafter
erected, constructed, re- constructed or altered except for one or more of the
following uses;
1.) Any use permitted in Single- Family Dwelling Use District A, above.
2.) Duplex. Tiro- Family Dwelling Units.
IV.
That Zoning Ordinance No. 33 be amended by the addition of Section
VII -B, as follows:
"In Apartment or Three or More Family Dwelling Districts, no building,
structure, land or premises shall be used and no building, or structure shall
be hereafter erected, constructed, re- constructed or altered except for one or
more of the following uses:
1.) Any use permitted in Single - Family Dwelling Use District A and
Duplex or Two - Family Dwelling Use District A -2, above.
2.) Apartment: Three or More Family Dwelling Units.
V.
All buildings erected in Duplex District A -2 and Apartment District
A -3 shall comply with the area, height, width, minimum lot and dwelling area,
and all front, side and rear yard requirements as is provided in Temporary
Zoning Ordinance No. 33 Regulations for Use, Single - Family Dwelling Use
District A.
VI.
If any section, subsection, sentence, clause, phrase or portion of this
Ordinance is for any reason held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate, distinct and
independent provision and such holding shall not affect the validity of the
remaining portions hereof.
VII.
THIS ORDINANCE shall be in full force and effect from and after its
passage as by law provided.
