FAMILY DISTRICT SECTION, 84 -106 "MH" MOBILE HOME DISTRICT,

INDUSTRIAL DISTRICT AND 84 -116 "TX -121" THE 121 GATEWAY
DISTRICT OF CHAPTER 84 "UNIFIED DEVELOPMENT CODE" OF
THE CODE OF ORDINANCES, CITY OF EULESS, TEXAS, TO
CLARIFY THE REQUIREMENT THAT ALL UTILITIES SHALL BE
BURIED; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A
SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Euless, Texas, has heretofore established
specific regulations requiring that utility facilities shall be placed underground with
certain minimal exceptions; and
WHEREAS, the specific inclusion of such requirement in each zoning district's
development standards will provide clarification of such requirement; and
WHEREAS, the City Council of the City of Euless, Texas, finds and determines that the
following amended regulations will promote the health, safety and welfare of the citizens
of the City of Euless,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS,TEXAS:
SECTION 1
That, Subsection (14) of Subsection (b) of Section 84 -101, "RAC" Single - Family Multi
Custom Dwelling District; Subsection (14) of Subsection (c) Section 84 -102 "R -1"
Single - Family Detached Dwelling District; Subsection (15) of Subsection (b) of Section
84 -103 "R-1 L" Single - Family Limited Dwelling District; Subsection (13) of Subsection (b)
of Section 84 -105 "R -2" Two - Family Dwelling District; Subsection (15) of Subsection (c)
of Section 84 -106 "MH" Mobile Home District; Subsection (17) of Subsection (c) of
Section 84 -107.5 "TH" Townhouse Dwelling District; Subsection (11) of Subsection (c)
of Section 84 -110 "C -1" Neighborhood Business District; Subsection (10) of Subsection
(b) of Section 84 -11 "C -2" Community Business District; Subsection (20) of Subsection
(c) of Section 84 -112 "TX -10" Texas Highway 10 Multi -Use District; Subsection (12) of
Subsection (c) of Section 84 -113 "LI" Limited Industrial District; Subsection (9) of
Subsection (b) of Section 84 -114 1-1" Light Industrial District; and Subsection (10) of
Subsection (b) of Section 84 -115 "1 -2" Heavy Industrial District of Chapter 84, "Unified
Development Code" of the Code of Ordinances of the City of Euless, Texas, as
amended, are hereby amended to hereafter be and read as follows, with all following
subsections, if any, being renumbered accordingly:
Utility Services - All utility services shall be buried. See Sec. 84-447 (2) (k)
Construction Standards for additional requirements.
SECTION 2
That Section 84 -116 "TX -121" the 121 Gateway District of Chapter 84, "Unified
Development Code ", of the Code of Ordinances of the City of Euless, Texas, as
amended, be and the same is hereby amended by the addition of a new subsection
(10) in Subsection (c) District Development Standards, to be and hereafter read as
follows:
(10) Utility Services. All utility services shall be buried. See Sec. 84-447
(2) (k) Construction Standards for additional requirements.
SECTION 3
Severability Clause. That it is hereby declared to be the intention of the City Council of
the City of Euless that the sections, paragraphs, sentences, clauses and phrases of this
ordinance are severable, and if any phrase, clause, sentence, paragraph or section of
this ordinance shall be declared invalid or unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall
not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION 4
Saving Clause. That Chapter 84 of the Code of Ordinances, City of Euless, Texas, as
amended, shall remain in full force and effect, save and except as amended by this
ordinance.
SECTION 5
Effective Date. This ordinance shall be in full force and effect from and after its
passage and publication as provided by the Euless City Charter and the laws of the
State of Texas.

PRESENTED AND GIVEN FIRST AND FINAL READING and approved at a
regular meeting of the Euless City Council on the 25th day of June, 2002, by a vote of
7 ayes, 0 nays and 0 abstentions.
