HomeMy WebLinkAbout1542 08-13-2002ORDINANCE NO. 1542 AN ORDINANCE AMENDING SECTION 78 -52 OF CHAPTER 78 OF THE CODE OF ORDINANCES, CITY OF EULESS, TEXAS, TO INCREASE THE AD VALOREM EXEMPTION FOR RESIDENTS OF THE CITY OF EULESS SIXTY -FIVE (65) YEARS OF AGE OR OLDER FROM THIRTY THOUSAND DOLLARS ($30,000) TO THIRTY FIVE THOUSAND DOLLARS ($35,000) OF THE ASSESSED VALUE OF SUCH RESIDENCE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; PROVIDING FOR PUBLICATION AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 1 -b of Article VIII of the Constitution of the State of Texas authorizes political sub - divisions to exempt from ad valorem taxation a portion of the value assessed as to residence homesteads of residents who are sixty -five (65) years of age or older, and, WHEREAS, the City of Euless, Texas, now exempts the sum of Thirty Thousand Dollars ($30,000) of the assessed value of a residence homestead for such citizens and desires to increase such exemption to the sum of Thirty Five Thousand Dollars ($35,000). NOW, THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,TEXAS: 1. That Chapter 78 "TAXATION ", Section 78 -52, "Homestead ad valorem exemption for persons sixty-five (65) or over - Granted" read as follows in its entirety: From and after January 1, 2002, and upon compliance with the requirements set forth in this division, there shall be exempted the sum of $35,000 of the assessed value of residence homesteads of residents of the city who are 65 years of age or older, from all ad valorem taxes thereafter levied by the city. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. Saving Clause. Chapter 78 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas.
