HomeMy WebLinkAbout1572 01-14-2003ORDINANCE NO. 1572 AN ORDINANCE AMENDING CHAPTER 30, "FEES ", SECTION 30 -4, "ANIMALS;" SECTION 30 -19, "FOOD AND FOOD SERVICE ESTABLISHMENTS;" SECTION 30 -20, "RETAIL FOOD STORES;" SECTION 30 -24, "DAY CARE, PUBLIC POOLS;" SECTION 30 -27, "RECREATION AREAS OR FACILITIES;" SECTION 30 -28, "LIBRARY;" SECTION 30 -30, "EMERGENCY MEDICAL SERVICE RATES;" SECTION 30 -34, "WATER DEPOSITS;" AND SECTION 30- 38, "MISCELLANEOUS FEES" OF THE CITY OF EULESS CODE OF ORDINANCES, PROVIDING A SAVING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL, CITY OF EULESS, TEXAS: SECTION 1 That Chapter 30, "Fees ", Section 30 -4, "Animals ", Subsection (k) "Adoption of Animals" be amended to read in its entirety as follows: (k) Adoption of Animals Dogs $ 25.00 Cats 20.00 Cat Spay 59.00 Cat Neuter 39.00 Dog Neuter 79.00 Dog Spay (2 -20 lbs.) 75.00 Dog Spay (21-40 lbs.) 85.00 Dog Spay (41-60 lbs.) 100.00 Dog Spay (61 -80 lbs.) 119.00 Dog Spay (81 -100 lbs.) 135.00 Dog Spay (100+ lbs.) 146.00 SECTION 2 That Chapter 30, "Fees ", Section 30 -19, "Food and Food Service Establishments ", be amended to read in its entirety as follows: Annual permit fee for food service establishment permit, license or certificate $235.00 Food handler certificate 10.00 Replacement for lost food handler certificate 5.00 Annual mobile food service establishment permit, per vehicle 100.00 Temporary food service establishment permit, per event location /booth 50.00 (3 days, 2 times per year) Seasonal food establishment 200.00 (6 weekends max., 2 times per year) SECTION 3 That Chapter 30, "Fees ", Section 30 -20, 'Retail Food Stores ", be amended to read in its entirety as follows: Annual permit fee SECTION 4 $235.00 That Chapter 30, "Fees ", Section 30 -24, "Day Care, Public Pools ", be amended to read in its entirety as follows: Public swimming pools and spas, annual permit fee $200.00 Day care, annual permit fee 100.00 SECTION 5 That Chapter 30, "Fees ", Section 30 -27, "Recreation Areas or Facilities ", Subsections (a), (d), (e), and (g) be amended to read as follows: (a) Bob Eden field rental: (1) Lighted per hour — resident $18.00 (2) Unlighted per hour — resident 10.00 (3) Lighted per hour — non - resident 22.00 (4) Unlighted per hour— non - resident 15.00 (5) Light Key Deposit 25.00 Ordinance No. 1572, Page 2 of 9 (d) Midway Recreation Center: (1) Arts & Crafts Room; Carr Park Gazebo - 4 hours Resident 25.00 Non - resident 50.00 (2) McCormick Park Gazebo - 4 hours Resident 25.00 Non - resident 50.00 (3) Bob Eden Park pavilion - 4 hours Resident 50.00 Non - resident 100.00 (4) Bear's Den pavilion - 4 hours Resident 50.00 Non - resident 100.00 (5) Texas Outdoor Education Trail (Amphitheater) pavilion - 4 hours Resident 50.00 Non - resident 100.00 (6) Texas Outdoor Education Trail (Amphitheater) stage & pavilion - 4 hours Resident 150.00 Non - resident 300.00 (7) Pavilion at the Parks at Texas Star — 4 hours Resident 50.00 Non - resident 100.00 Ordinance No. 1572, Page 5 of 9 (8) Each additional hour for above facilities 10.00 (9) Each additional hour for Amphitheater Stage & Pavilion 20.00 SECTION 6 That Chapter 30, "Fees ", Section 30 -28, "Library', Subsection (2), "Library Meeting Room Charge ", be amended to read in its entirety as follows: (2) Library Meeting Room: (a) Library Meeting Room A or Meeting Room B charge: (1) Base Room Charge — per hour 35.00 (three -hour minimum) (2) Each additional hour 35.00 (3) Food Fee - per event 25.00 (4) Audio Visual Rental — per hour 15.00 (three -hour minimum) (5) Attendant Fee (after hours only) — per hour 15.00 (three -hour minimum) (b) Library Meeting Rooms A and B charge: (1) Base room charge — per hour 60.00 (three -hour minimum) (2) Each additional hour 60.00 (3) Food Fee — per event 25.00 (4) Audio Visual Rental — per hour 15.00 (three -hour minimum) (5) Attendant Fee (after hours only) — per hour 15.00 (three -hour minimum) (c) Payment policy A signed contract and payment in full of the room charge is required to secure the room reservation. Refunds on room charges are made when the cancellation is received in writing two weeks prior to the Ordinance No. 1572, Page 6 of 9 event. If the reservation is cancelled less than two weeks prior to the event refunds will be considered on an individual basis. (d) Damage Deposits No food or drinks served Food or drinks served 100.00 500.00 This deposit will serve as security for any additional cleanup of the facility and will be applied toward any damage to the facility. The deposit is to be paid by separate check with signed contract. The damage deposit will be refunded to the patron within ten business days after the date of the reservation and after a thorough inspection of the meeting facility. The damage deposit will be refunded if the reservation is cancelled two weeks prior to the event. If the reservation is cancelled less than two weeks prior to the event the Damage Deposit refund will be considered on an individual basis. (e) Security Officer $25.00 per hour (3 hour minimum). Any event with over 100 persons in attendance will be reviewed to see if a security officer should be present. Any event with over 150 persons in attendance will be required to employ an officer. The renter will pay the officer at the end of the evening. This fee is in addition to attendant fee. (f) Catering An approved caterers' list will be available to those wishing to have an event catered. Approval of a caterer involves providing a Certificate of Insurance with the City of Euless named as an additional insured on said certificate, a copy of Certificate of Health, and a signed catering agreement with the city is due two weeks prior of planned event. SECTION 7 That Chapter 30, "Fees ", Section 30 -30, "Emergency Medical Service Rates ", be amended to read in its entirety as follows: Sec. 30 -30. Emergency medical service rates (includes drugs and supplies): Basic Life Support $425.00 Advanced Life Support Ordinance No. 1572, Page 7 of 9 525.00 Advanced Life Support II Resident Discount Mileage Aid given for resident — no transport Aid given for nonresident — no transport SECTION 8 625.00 100.00 $5.50 per patient mile 50.00 100.00 That Chapter 30, "Fees ", Section 30 -34, 'Water Deposits ", be amended by the addition of the following as the second paragraph under "Delinquent Accounts" to be and hereafter read as follows: Delinquent commercial and multi - family utility accounts subject to delinquent turn off will be billed an additional security deposit not to exceed thirty percent (30 %) of the average monthly billing or as deemed appropriate by the Utility Billing Manager upon review of the utility account. SECTION 9 That Chapter 30, "Fees ", Section 30 -38, "Miscellaneous Fees ", be amended by adding the following as the first item of this section: Delinquent debt or account referred for collection Additional 30% fee SECTION 10 SAVING CLAUSE. That applicable chapters of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND APPROVED ON THE FIRST AND FINAL READING on the 14`" day of January, 2003, at a regular meeting of the City Council of the City of Euless, Texas, by a vote of 5 ayes, 0 nays and 0 abstentions.
