HomeMy WebLinkAbout1580 03-11-2003ORDINANCE NO. 1580 AN ORDINANCE CHANGING THE BOUNDARY OF THE CITY OF EULESS, TEXAS, BY ADOPTING AN AGREEMENT ESTABLISHING A NEW COMMON BOUNDARY LINE BETWEEN THE CITY OF BEDFORD, TEXAS, AND THE CITY OF EULESS, TEXAS. WHEREAS, the cities of Euless and Bedford desire to change and redefine their common bo,,ndary in an area less than 1,000 feet in width as authorized by Section 43.031, Texas Local Government Code, and; WHEREAS, such new common boundary line will cause two parcels of land currently within the City of Bedford to be incorporated into the City of Euless, shown on Exhibits A and C attached to the agreement adopted hereby; and WHEREAS, such new common boundary line will cause one parcel of land currently within the City of Euless to be incorporated into the City of Bedford as shown on Exhibit B attached to the agreement adopted hereby; and WHEREAS, such new common boundary line has been surveyed and is depicted on Exhibit D attached to the agreement adopted hereby, and all of said exhibits and said agreement have been prepared for adoption by ordinance of each city. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT the attached agreement, styled Mutually Agreed Change of Bedford and Euless Boundary of Area of Less Than 1,000 Feet in Width, together with Exhibits A, B, C, and D attached thereto, be adopted and that the Mayor be authorized to execute said agreement. SECTION 2 THAT the parcels of property depicted on Exhibits A and C attached to said agreement, currently within the City of Bedford, shall be hereby incorporated into the City of Euless, and that property currently within the City of Euless depicted on Exhibit B attached to the agreement to be adopted hereby shall be hereby incorporated into the City of Bedford. SECTION 3 THAT the area south of the changed common boundary line established by the foregoing agreement and as shown on Exhibit D attached thereto be disannexed from and discontinued as a part of the City of Euless. SECTION 4 THAT the area north of the changed common boundary line established by the foregoing agreement and depicted on Exhibit D attached thereto be annexed to and become incorporated as a part of the City of Euless. SECTION 5 Severability Clause. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 6 Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. NOW, THEREFORE, the parties hereto do hereby agree as follows: 1. The parties to this agreement are the Cities of Bedford and Euless, acting herein by and through their duly authorized Mayors. 2. The parcels of land depicted on Exhibits A and C attached hereto, which currently lie within the City of Bedford, shall be hereby incorporated into the City of Euless. The parcel of land depicted on Exhibit B attached hereto, which currently lies within the City of Euless, shall hereby be incorporated into the City of Bedford. The new boundary line depicted on Exhibit D attached hereto shall be the boundary line hereafter between the Cities of Bedford and Euless. The area south of such line shall be deemed disannexed by Euless and annexed by Bedford. The area north of such line shall be deemed disannexed by Bedford and annexed by Euless. 3. This agreement shall be effective upon its adoption by ordinance of both cities and upon execution of this agreement by the Mayors of each city.
