HomeMy WebLinkAbout1633 03-23-2004ORDINANCE NO. 1633 AN ORDINANCE AMENDING CHAPTER 84 "UNIFIED DEVELOPMENT CODE" OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS, ARTICLE VII "LANDSCAPING, FENCES, WALLS, SCREENING AND OUTDOOR STORAGE REQUIREMENTS ", SECTION 84 -336 "SCREENING REQUIREMENTS ", SUBSECTION (b) "TYPES OF SCREENING (IN GENERAL) ", SUBSECTION (4) "MASONRY WALL ", TO ADD CERTAIN REQUIREMENTS FOR ALL MASONRY WALLS; AND AMENDING SUBSECTION (d) "SCREENING REQUIRED BETWEEN USES AND DISSIMILAR DISTRICTS', TABLE 7 -A "MINIMUM SCREENING BETWEEN USES AND DISTRICTS" TO REQUIRE A MASONRY WALL TO BE CONSTRUCTED BETWEEN ONE- AND TWO- FAMILY RESIDENTIAL DEVELOPMENTS AND PUBLIC RIGHTS -OF -WAY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Euless, Texas, finds and determines that the public health, safety and welfare would be best served by requiring masonry walls between one - and two- family residential developments and public rights -of -way; and WHEREAS, the Euless City Council further finds and determines that certain additional technical requirements are necessary in the construction of any masonry walls within the city; and WHEREAS, the following ordinance provisions will accomplish these public purposes. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS,TEXAS: SECTION 1 THAT Chapter 84 "UNIFIED DEVELOPMENT CODE" of the Code of Ordinances of the City of Euless, Texas, Article VII "LANDSCAPING, FENCES, WALLS, SCREENING AND OUTDOOR STORAGE REQUIREMENTS', Section 84-336 "SCREENING REQUIREMENTS ", Subsection (4) "MASONRY WALL ", be hereby amended to read in its entirety as follows: Sec. 84 -336. Screening requirements. (4) Masonry wall. A masonry fence or wall shall be constructed with the finish side out and of any of the following materials: native stone, brick, precast concrete panels with decorative finish or decorative masonry unit. In no case shall more than 25 percent of the area of the wall be erected with common smooth faced masonry units. Masonry wall panels must be engineered with structural concrete footings. Steel lintels shall be required for thin wall construction. Brick detailing shall be added to the top of a masonry wall to produce a change in texture and plane, and offsets shall be created in the wall to provide visual variety. Masonry columns must be installed at a maximum of 30 feet on centers, shall be taller than the rest of the wall, and shall have decorative caps. SECTION 2 THAT Chapter 84 "UNIFIED DEVELOPMENT CODE" of the Code of the Ordinances of the City of Euless, Texas, Article VII "LANDSCAPING, FENCES, WALLS, SCREENING AND OUTDOOR STORAGE REQUIREMENTS ", Section 84-336 "SCREENING REQUIREMENTS ", Subsection (d) SCREENING REQUIRED BETWEEN USES AND DISSIMILAR DISTRICTS', Table 7 -A "MINIMUM SCREENING BETWEEN USES AND DISTRICTS' be hereby to read in its entirety as follows: Table 7 -A. SECTION 3 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 4 SAVINGS CLAUSE. Chapter 84 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 5 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 23rd day of March, 2004, by a vote of 6 ayes, 0 nays, and 0_ abstentions.
