AN ORDINANCE AMENDING TABLE 4 -A "PERMITTED
PRIMARY USES" OF SECTION 84 -84 "PERMITTED USES
TABLE" OF ARTICLE IV "ZONING DISTRICT
REGULATIONS" OF CHAPTER 84 "UNIFIED
DEVELOPMENT CODE" OF THE CODE OF ORDINANCES
OF THE CITY OF EULESS, TEXAS, TO REMOVE TRUCK
RENTAL AND LEASING AS A PERMITTED USE IN THE TX-
10 DISTRICT AND TO ADD PASSENGER CAR RENTAL
AND PASSENGER CAR LEASING AS PERMITTED USES
WITH SPECIFIC USE PERMITS IN C -2, LI, 1 -1, 1 -2 AND THE
TX -10 DISTRICT; PROVIDING A SEVERABILITY CLAUSE,
PROVIDING A SAVING CLAUSE AND AN EFFECTIVE
DATE.
WHEREAS, the City Council of the City of Euless, Texas, has found after study and
experience that truck rental and leasing operations are incompatible with other land uses
in the 'TX -10" Texas Highway 10 Multi -Use District; and
WHEREAS, passenger car leasing operations, as distinguished from car rental
operations, are becoming a more prevalent use throughout the Metroplex; and
WHEREAS, the Euless City Council, after study, finds and determines that
passenger car rental and passenger car leasing operations would be compatible with other
uses in the C -2, TX -10, LI, 1 -1, and 1 -2 zoning districts with specific use permits to control
their impact on surrounding uses and traffic patterns, and
WHEREAS, the City Council of the City of Euless, Texas, hereby finds that the
public health, safety and general welfare will be best served by making the changes in
permitted uses contemplated by this ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION 1
THAT the "Automotive Services" section of Table 4 -A "PERMITTED PRIMARY
USES" as contained in Section 84-84 "PERMITTED USES TABLE" of Article IV "ZONING
DISTRICT REGULATIONS" of Chapter 84 "UNIFIED DEVELOPMENT CODE" of the Code
of Ordinances of the City of Euless, Texas, as amended, be hereby amended to add a new
SIC Code 7513 'TRUCK RENTAL AND LEASING, WITHOUT DRIVERS" and to provide
that such use would be permitted with a specific use permit in zoning categories C -2, LI,
1 -1 and 1 -2; and adding a SIC Code 7514 "PASSENGER CAR RENTAL" and changing the
designation of SIC Code 7515 to "PASSENGER CAR LEASING', and providing that both
of such passenger car uses would be permitted with a specific use permit in Zoning
Districts C -2, TX -10, LI, 1 -1 and 1 -2.
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses, and
phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph,
or section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect any
of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance,
since the same would have been enacted by the City Council without the incorporation in
this ordinance of any such unconstitutional phrase.
SECTION 3
SAVINGS CLAUSE. Chapter 84 of the Code of Ordinances, City of Euless, Texas,
as amended, shall remain in full force and effect, save and except as amended by this
ordinance.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after
its passage, as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND APPROVED ON FIRST AND FINAL READING at a
regular meeting of the Euless City Council on the 23rd day of March, 2004, by a vote of
6 ayes, 0 nays, and 0 abstentions.
