HomeMy WebLinkAbout1641 05-11-2004ORDINANCE NO. 1641 AN ORDINANCE VACATING AND ABANDONING A UTILITY EASEMENT LOCATED ON LOTS 18 AND 19, BLOCK A, WOODBURY FOREST ADDITION, IN THE CITY OF EULESS, TARRANT COUNTY, TEXAS, AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Euless, Texas, after careful study and consideration has determined that the utility easement hereinafter, specifically described, is not being used by, or useful, or convenient to the public in general; therefore, it constitutes a public charge without a corresponding public benefit, and the public would be better served and benefited by its vacation and abandonment. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS, THAT: SECTION 1 The utility easement located on Lots 18 and 19, Block A, Woodbury Forest Addition, in the City of Euless, Tarrant County, Texas, particularly described in Exhibit 1 and Exhibit 2 attached hereto and made a part hereof for all intents and purposes, is hereby vacated and abandoned as a utility easement. SECTION 3 EFFECTIVE DATE. This ordinance shall become effective immediately from and after its passage as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND GIVEN FIRST AND FINAL READING, and approved at a regular meeting of the Euless City Council on the 11th day of May, 2004, by a vote of 7 ayes, 0 nays, and 0 abstentions. APPROVED: APPROV D AS TO RM: r, Mary Lib SaI h, Mayor Bob McFa-rli—ncr, City Attorney ATTEST: usan Crim, C C, City Secretary EASEMENT LOCATION 2616 & 2618 Tallow Drive, Euless, Texas 76039 EXHIBIT NUMBER 1 Being that portion of the Bryant Harrington Survey, Abstract No. 808, Tarrant County, Texas, and being a part of the Woodbury Forest Addition as recorded in Volume 388 -194, Page 44, of the Plat Records in the City of Euless, Tarrant County, Texas, and being more particularly described as follows: EASEMENT Boundary Description of a Utility Easement on Lot 18 & 19, Block A COMMENCING at the southeast corner of Lot 18, Block A o< said Woodbury Forest Addition; THENCE North 89 degrees 46 minutes 50 seconds West along the south line of said Lot 18 a distance of 7.50 feet to the POINT OF BEGINNING; THENCE North 89 degrees 46 minutes 50 seconds West along the said south line a distance of 5.00 feet to a point for corner; THENCE North 01 degrees .37 minutes 15 seconds East a distance of 128.31 feet to a point for corner in the north line of Lot 19, Block A of said Woodbury Forest Addition; THENCE South 88 degrees 22 minutes 45 seconds East along the said north line a distance of 5.00 feet to a point for corner in the west line of an existing utility easement as platted with said Woodbury Forest Addition; THENCE South 01 degrees 37 minutes 15 seconds West along the said west line a distance of 128.18 feet to the POINT OF BEGINNING and containing 641.22 square feet of land, more or less. EASEMENT LOCATION 2616 & 2618 Tallow Drive, Euless, Texas 76039 EXHIBIT NUMBER 2 The following is a plat or sketch of the utility /drainage easement sought to be vacated in the above numbered application, showing the surrounding area to the nearest streets in all directions, abutting lots, the block or blocks in which the portion of the utility /drainage easement sought to be vacated is situated, and the addition or additions in which the portion of the utility / drainage easement sought to be vacated is situated. Also, the names of record owners of the abutting lots are shown: Please see "Exhibit A" for legal description and plat of easement.
