HomeMy WebLinkAbout1646 06-08-2004ORDINANCE NO. 1646 AN ORDINANCE AMENDING CHAPTER 10, "ANIMALS ", OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS, AS AMENDED; BY AMENDING SECTION 10 -104, "RESTRICTIONS ON SIZE AND LOCATIONS OF AREA FOR KEEPING LIVESTOCK", RELATIVE TO THE MINIMUM AREA REQUIRED FOR KEEPING AND MAINTININING ANY LIVESTOCK WITHIN AN ENCLOSED AREA; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, currently Chapter 84 and Chapter 10 are in conflict to the extent of the minimum enclosed area required for maintaining livestock, WHEREAS, the minimum area for the size of area required for maintaining livestock shall be no less than one -half acre (21,780 square feet) per animal, WHEREAS, the City Council has determined that the proposed change is in the best interest of the general welfare of the City of Euless; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TARRANT COUNTY, TEXAS: SECTION 1 THAT Section 10 -104, entitled "Restrictions on size and locations of area for keeping livestock ", be amended by removing the following "of less than one acre (43,560 square feet) per animal, and be changed to read as: "of less than one -half acre (21,780 square feet) per animal. SECTION 2 SEVERABILITY CLAUSE; That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
