AN ORDINANCE VACATING AND ABANDONING A
SANITARY SEWER EASEMENT LOCATED IN TRACT
2E3, LEVI FRANKLIN SURVEY, ABSTRACT NO. 513
(BEAR CREEK ESTATES, PHASE IV), IN THE CITY OF
EULESS, TARRANT COUNTY, TEXAS, AND DECLARING
AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Euless, Texas, after careful study and
consideration has determined that the sanitary sewer easement hereinafter, specifically
described, is not being used by, or useful, or convenient to the public in general;
therefore, it constitutes a public charge without a corresponding public benefit, and the
public would be better served and benefited by its vacation and abandonment.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
EULESS, TEXAS, THAT:
SECTION 1
The utility easement located in Tract 2E3, Levi Franklin Survey, Abstract No. 513, in the
City of Euless, Tarrant County, Texas, particularly described in Exhibit 1 and Exhibit 2
attached hereto and made a part hereof for all intents and purposes, is hereby vacated
and abandoned as a utility easement.
SECTION 2
EFFECTIVE DATE. This ordinance shall become effective immediately from and after
its passage as provided by the Euless City Charter and the laws of the State of Texas.
PRESENTED AND GIVEN FIRST AND FINAL READING, and approved at a regular
meeting of the Euless City Council on the 17th day of August, 2004, by a vote of 7
ayes, 0 nays, and 0 abstentions.

PARTIAL ABANDONMENT OF A
15 -FOOT SANITARY SEWER EASEMENT
Being a 0.165 of an acre tract of land in the Levi Franklin Survey, Abstract No. 513, Tarrant
County, Texas, said 0.165 of an acre tract being a northerly portion of a 15 -foot Sanitary
Sewer Easement described in a deed to the City of Euless and recorded in Volume 7778,
Page 1143, Deed Records, Tarrant County, Texas and being a portion of 7.511 acres out of a
14.896 acre tract of land described in a deed to Euless Joint Venture, Inc. and recorded in
Volume 9941. Page 2112. Said 0.165 of an acre tract being more particularly described as
follows:
Beginning at a 5/8' iron with cap set in concrete in the westerly line of Baze Road and being a
northerly comer of said 7.511 acres from which a 518" iron with cap set in concrete, at the
southeast comer of Lot 10, Block 7, Bear Creek Estates Addition, Phase II, an addition to the
City of Euless as shown on the plat recorded in Volume 388 -170, Page 84, Plat Records,
Tarrant County, Texas, bears N 01 degrees 11 minutes 33 seconds E, 100.00 feet;
Thence with the easterly line of said 15 -foot Sanitary Sewer Easement the following calls:
S 88 degrees 48 minutes 42 seconds E with a northerly line of said 7.511 acres, 15.00
feet;
S 01 degrees 11 minutes 33 seconds W, 10.00 feet to the beginning of a curve to the
left;
202.28 feet with the arc of said curve to the left. Said curve to the left has a radius of
289.84 feet, a central angle of 39 degrees 59 minutes 13 seconds and a long chord
which bears S 18 degrees 48 minutes 03 seconds E, 198.20 feet;
S 38 degrees 47 minutes 42 seconds E, 186.17 feet to the beginning of the first curve to
the right;
82.33 feet with the arc of said first curve to the right to the southerly line of said 7.511
acres and the northerly line of Mid- Cities Boulevard and being the beginning of a
second curve to the right from which a 518" iron with cap set in the southerly line of said
7.511 acres bears N 89 degrees 27 minutes 36 seconds E, 300 -80 feet_ Said first curve
to the right has a radius of 387.49 feet, a central angle of 12 degrees 10 seconds 25
minutes and a long chord which bears S 32 degrees 42 minutes 32 seconds E, 82.17
feet;
17.63 feet with the arc of said second curve to the right, being the southerly line of said 7.511
acres and the northerly line of Mid -Cities Boulevard to the westerly line of said 15 -foot Sanitary
Sewer Easement, being the beginning of a curve to the left Said second curve to the right has
a radius of 1849.86 feet, a central angle of 00 degrees 32 minutes 46 seconds and a long
chord which bears N 85 degrees 36 minutes 12 seconds W, 17.63 feet;
Thence with the westerly line of said 15 -foot Sanitary Sewer Easement the following calls:
70.05 feet with the arc of said curve to the left_ Said curve to the left has a radius of
372.49 feet, a central angle of 10 degrees 46 minutes 32 seconds and a long chord
which bears N 33 degrees 24 minutes 27 seconds W, 69.95 feet;
N 38 degrees 47 minutes 42 seconds W, 166.17 feet to he beginning of a curve to the
right;
212.75 feet with the arc of said curve to the right. Said curve to the right has a radius of
304.84 feet, a central angle of 39 degrees 59 minutes 14 seconds and a long chord
which bears N 18 degrees 48 minutes 05 seconds W, 208.46 feet;
N 01 degrees 11 minutes 33 seconds E. 10.00 feet to the point of beginning and
containing 0.165 of an acre or 7,198 square feet of land.
