HomeMy WebLinkAbout1668 11-23-2004ORDINANCE NO. 1668 AN ORDINANCE AMENDING CHAPTER 30 "FEES" OF THE "CODE OF ORDINANCES" OF THE CITY OF EULESS BY AMENDING SECTION 30 -39 "PLANNING AND ZONING FEES "; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, said Planning and Zoning sign fees do not allow the City to recover its costs for providing the services for which such fees are charged; and WHEREAS, the updated fees listed herein more closely represent the cost of said services, thereby placing the burden on the party benefiting from said services, rather than the taxpayers in general. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 Section 30 -39 "Planning and Zoning Fees ", Subsection (3) "Signs" of Chapter 30 "Fees" of the Code of Ordinances for the City of Euless, be amended to read as follows: Sec. 30 -39 Planning and Zoning Fees. (3) Signs: Annual permit for permanent off - premises sign, per year ........:... $35.00 Weekend permit for temporary off - premises signs, per weekend ... $10.00 Special event sign, per event .................. ............................... $40.00 SECTION 2 SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3 SAVING CLAUSE. That Chapter 30 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 23rd day of November, 2004, by a vote of 7 ayes, 0 nays, and 0 abstentions.
