HomeMy WebLinkAbout167 05-31-1962ORDINANCE NO. 167 AN ORDINANCE CALLING AN ELECTION ON THE QUESTION OF WHETHER OR NOT THE PROPOSED HOME RULE CHARTER FOR THE CITY OF EULESS SHALL BE ADOPTED; CALLING SUCH ELECTION ON SATURDAY, JULY 21, 1962; PROVIDING THAT THE CITY SHALL CONSTITUTE ONE VOTING PRECINCT AND THAT THE PLACE OF ELECTION SHALL BE EULESS CITY HALL; DESIGNATING ELECTION OFFICIALS AND PROVIDING FOR A REGULAR VOTING, FOR ABSENTEE BALLOTING AND FOR CONDUCT OF SAID ELECTION IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS FOR THE HOLDING OF GENERAL AND SPECIAL ELECTIONS IN THE MANNER AND FORM PROVIDED BY THE ELECTION CODE OF THE STATE OF TEXAS AND BY THE LAWS GOVERNING MUNICIPAL ELECTIONS. WHEREAS, pursuant to the authority of Section 5, Article XI. of the Constitution of the State of Texas, and Chapter XIII of Title 28, Articles 1165 through 1182, as amended, Revised Civil Statutes of the State of Texas, cities actually containing more than 5,000 inhabitants may adopt a Home Rule Charter; and WHEREAS, it has been duly and properly determined that the City of Euless has the requisite number of inhabitants to consider the adoption of a Home Rule Charter; and WHEREAS, the Charter Commission, chosen by the voters of the City of Euless on November 18, 1961, has prepared and completed for submission to the citizens of Euless a proposed Home Rule Charter; and WHEREAS, the City Council of the City of Euless has unanimously voted to submit to the qualified voters of the City of Euless the proposition of whether or not the proposed Home Rule Charter shall be adopted; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL of the City of Euless, Texas: I. That the City Council of the City of Euless, Texas, at a Special Called Meeting held on this 31st day of May, 1962, called for the expressed and duly published purpose of calling an election for a vote by the duly qualified voters of the City of Euless on such proposed Charter, does hereby order an election to be held on Saturday, July 21, 1962, for submission of the proposition to the voters of the City of Euless whether or not the proposed Home Rule Charter shall be adopted, such proposition to be submitted substantially in the following form: "FOR the adoption of the proposed Home Rule Charter" "AGAINST the adoption of the proposed Home Rule Charter" II. The Euless City Council does hereby order the City Secretary to mail a copy of the proposed Charter to each qualified voter in the City of Euless as appears from the Tax Collector's rolls for the year ending January 31, 1962, not less than thirty (30) days prior to such election. III. For the purpose of said election, the entire City is hereby constituted one voting precinct; the polling place for said election shall be the City Hall within said City and said election shall be held between the hours of 7:00 A.M. and 7:00 P.M. on the aforementioned date, and the following persons /persons are hereby appointed to act as election officers: /!l -, , „�i 11, ff^ /� 1 Z. , , Presiding Judge �,;, L 4 h� /C • l l C, Assistant Presiding Judge r,: 14 < < de ., Clerk Clerk IV. Ballot to be used in said election shall be prepared in the manner and form provided by the Election Code of the State of Texas enacted by the 1951 Legislature, and as amended, and further pursuant to the provision of Title 28, Articles 1165 through 1182, as amended, Revised Civil Statutes of the State of Texas. V. All qualified voters within the meaning and laws of the State of Texas who have resided in the State of Texas for one (1) year and in the City of Euless for six (6) months prior to the date of the election called herein shall be entitled to vote at such election. Vi. Voting by absentee ballot in said election shall commence on the 28th day of June, 1962, at the office of the City Secretary, Euless, Texas. Voting by absentee ballot shall close at 5:00 P.M. on the 17th day of July, 1962. VII. The election officers above -named shall make and deliver the returns of said election in triplicate, one being retained by the Presiding Judge, one delivered to the Mayor of the City and one delivered to the City Secretary. The ballot box containing the signature stubs from ballots used in said election shall be delivered to the District Clerk of Tarrant County, Texas, and other ballot boxes and election records and supplies shall be preserved by the City Secretary in the proper office as by law provided. The City Council shall meet not more than three (3) days after the date of the election for the purpose of canvassing the returns of said election. VIII . The Mayor is hereby directed to give Notice of said election which shall be signed by the Mayor, under the attest of the City Secretary, and shall state the purpose of the election, the officers to be elected, and the Chief of Police shall post a properly executed copy of the election proclamation at the polling place herein provided and two copies at two other public places within the City. Such notices shall have attached thereto a certified copy of this Resolution. IX. Said election shall be held and conducted in accordance with the laws of the State of Texas for the holding of general elections for State and County offices except as otherwise provided by Chapter 2, Title 28, of the Revised Civil Statutes of Texas.
