ORDINANCE AMENDING CHAPTER 30, "FEES,"
SECTION 30 -30, "EMERGENCY MEDICAL SERVICE
RATES (INCLUDES DRUGS AND SUPPLIES)," OF THE
CODE OF ORDINANCES OF THE CITY OF EULESS,
TEXAS; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVING CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Euless, Texas, has determined it necessary to enter into
a contractual agreement for Emergency Medical Services accounting services; and,
WHEREAS, the City Council has determined it is in the best interest of the
citizens to utilize a third party ambulance billing entity.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION 1
THAT Section 30 -30, "Emergency Medical Service Rates (Includes Drugs and
Supplies)" of Chapter 30, "Fees," of the Code of Ordinances, City of Euless, Texas,
shall be re- titled, "Emergency Medical Service Rates," and shall hereby be amended to
hereafter be and read as follows:
Section 30 -30. Emergency Medical Service Rates
Ambulance fees for the use of city ambulances will be set in accordance with the
formula set forth by the third party billing agency. The third party agency will use
reasonable best efforts to determine and use standard pricing for the services. Charges
and rates for services will be based on prevailing charges and provider's demographic
service area.
SECTION 2
SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City
Council of the City of Euless that the sections, paragraphs, sentences, clauses, and
phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph,
or section of this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent jurisdiction, such unconstitutionality shall not affect
any of the remaining phrases, clauses, sentences, paragraphs, or sections of this
ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such unconstitutional phrase.
SECTION 3
SAVING CLAUSE. That Chapter 10 of the Code of Ordinances, City of Euless,
Texas, as amended, shall remain in full force and effect, save and except as amended
by this ordinance.
SECTION 4
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after
its passage and publication as provided by the Euless City Charter and the laws of the
State of Texas.
PRESENTED AND GIVEN FIRST AND FINAL READING at a regular meeting of
the Euless City Council on the 8th day of February, 2005, by a vote of 7 ayes,
0 nays, and 0 abstentions.
