HomeMy WebLinkAbout1680 02-22-2005ORDINANCE NO. 1680 AN ORDINANCE AMENDING SECTION 84 -232, "DEFINITIONS," ARTICLE VI, "SIGNS AND STREET GRAPHICS REGULATIONS," OF CHAPTER 84, "UNIFIED DEVELOPMENT CODE," OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND AN EFFECTIVE DATE. WHEREAS, city staff has performed a comprehensive review of the city's current sign regulations; and WHEREAS, it is the desire of the Euless City Council to adopt these added sign definitions contained in Chapter 84 "Unified Development Code" of the Code of Ordinances; and WHEREAS, the city council of the City of Euless finds and determines that the additions made hereby will promote the health, safety and general welfare of the citizens of the City of Euless. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 Section 84 -232 "Definitions" of the Code of Ordinances for the City of Euless, be hereby amended by adding the following: Sec. 84 -232 Definitions. Banner Signs (Temporary) — Means possessing characters, letters, illustrations, or ornamentation; applied to non -rigid light weight fabric or similar material; intended to be hung without frames; can only be used if there is a legally permitted permanent name sign; must be used ancillary to the legally permanent name sign; and, must obtain Special Event Permit. Fagade — Any separate face of a building, including parapet walls and omitted wall line, or any part of a building, which encloses or covers usable space. Fagade Signs (Exterior) — Means possessing characters, letters, illustrations, or ornamentation; constructed of rigid and non /flexible materials, framed, flush mounted to facade; must not cover windows or doors; and, total sign coverage on any wall or window signs may not exceed 30% of wall elevation inclusive of windows and doors. SECTION 2 SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the section, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION 3 SAVING CLAUSE. That Chapter 84 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 4 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 22nd day of February, 2005, by a vote of 7 ayes, 0 nays, and _abstentions.
