HomeMy WebLinkAbout1688 05-31-2005ORDINANCE NO. 1688 AN ORDINANCE OF THE CITY OF EULESS, TEXAS, AMENDING CHAPTER 34 `FIRE PREVENTION AND PROTECTION' OF THE CITY OF EULESS CODE OF ORDINANCES, BY REPEALING SECTIONS 34- 40 "ROPING OFF FIRE SCENE "; 34-41 "COMMAND OF FIRE OFFICIALS AT FIRES"; 34 -68 "INVESTIGATING FIRES; RECORDS "; 34 -73 "RIGHT OF ENTRY "; 34 -74 "INSPECTION ON COMPLAINT OR PERIODICALLY; APPEALS FROM ORDERS; REPORTS TO STATE FIRE MARSHAL "; 34 -106 "SERVICE STATIONS "; 34 -107 "MOBILE SERVICE STATION UNITS PROHIBITED "; 34 -131 "FIRE LANE MARKING "; AND 34 -132 "OBSTRUCTING "; AMENDING SECTION 34- 105 "AMENDMENTS" SUBSECTION (64) "SECTION 508.5.1.2 HYDRANT PLACEMENT" (d) AND (e); AND AMENDING SUBSECTION (79) "SECTION 903.1.3 "EXISTING STRUCTURES" (b); PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Euless, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City wishes to amend certain sections of the Code of Ordinances to remove duplication of certain sections that are contained in both the International Fire Code and the Code of Ordinances as stand alone sections; and WHEREAS, the City wishes to amend Section 903.1.3(b) of the 2003 International Fire Code to provide a definition exclusive to that section; WHEREAS, the City Manager and his staff have recommended these changes, and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION I THAT Sections 34-40 "Roping Off Fire Scene "; 34-41 "Command of Fire Officials at Fires "; 34 -68 "Investigating Fires; Records "; 34 -73 "Right of Entry"; 34 -74 "Inspection on Complaint or Periodically; Appeals From Orders; Reports to State Fire Marshal "; 34- 106 "Service Stations "; 34 -107 "Mobile Service Station Units Prohibited "; 34 -131 "Fire Lane Marking "; and 34 -132 "Obstructing ", of the City of Euless Code of Ordinances, be hereby repealed. SECTION II THAT Section 34 -105 "Amendments ", Subsection (64) "Section 508.5.1.2 Hydrant Placement" (d) and (e) of the City of Euless Code of Ordinances be amended to hereafter be and read as follows: Section 508.5.1.2 Hydrant Placement. Fire hydrants shall be placed as follows: (d) All fire hydrants shall be placed so the four and 'h inch (4 ' /2") opening on the hydrant is located between sixteen and three - quarters inches (16 -3/4 ") and twenty -one and one quarter inches (21 % ") from the finished grade of the property in compliance with the City of Euless engineering standards. Fire hydrants may not be placed closer than thirty -six (36 ") inches nor more than five feet (5) from the back of the curb or the edge of the roadway. The City may require fittings on the steamer connection that are other than NST discharges. (e) Only National Standard, three way hydrants are approved. Hydrants must contain National Standard threads and must have one four and '/2 (4-1/2) inch and two — two and one half inch (2' /a ") connections. All hydrants must be of a type approved by the City engineering department. SECTION III THAT Section 34 -105 "Amendments ", Subsection (79) "Section 903.1.3 Existing Structures" (b) be amended to hereafter be and read as follows: (b) When a building (a structure or any lease space or useable space located within the confines of that structure) has been vacant for more than six (6) months; SECTION IV SAVING CLAUSE. That Chapter 34 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION V SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by Ordinance No. 1688, Page 2 of 3 the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase. SECTION VI EFFECTIVE DATE_ This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas. PRESENTED AND PASSED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 31st day of May, 2005, by a vote of 7 ayes, 0 nays, and o_ abstentions.
