AN ORDINANC AMENDING CHAPTER 86 "UTILITIES,"
SECTION 86 -0 "DROUGHT CONTINGENCY PLAN,"
SUBSECTION (b) "DROUGHT STAGES - TRIGGER
CRITERIA, ACTIONS, AND TERMINATION" OF THE
CODE OF ORDINANCES OF THE CITY OF EULESS,
TEXAS, AS AMENDED; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A SAVING CLAUSE AND AN
EFFECTIVE DATE.
WHEREAS, the City of Euless recognizes that the amount of water available to
its customers is limited; and
WHEREAS, due to natural limitations and drought conditions, the City cannot
guarantee an uninterrupted water supply for all purposes at all times; and
WHEREAS, the Texas Water Code and the regulations of the Texas
Commission on Environmental Quality require that the city adopt a drought contingency
plan; and
WHEREAS, Title 30, Part 1, Chapter 288, Subchapter B, Rule 288.20,
Subsection F of the Texas Administrative Code requires that the Drought Contingency
Plan include specific, quantified targets for water use reduction to be achieved during
periods of water shortage and drought.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS, TEXAS:
SECTION I
THAT Chapter 86 "Utilities," Section 86 -36 "Drought Contingency Plan,"
Subsection (b) "Drought Stages- Trigger Criteria, Actions, and Termination" of the Code
of Ordinances of the City of Euless, Texas, be hereby amended so that it shall hereafter
be and read as follows:
Sec. 86 -36. Drought contingency plan.
(b) Drought stages- Trigger criteria, actions, and termination. The city manager or
his /her designee in consultation with the TRA will monitor water supply and /or
demand conditions and shall determine when conditions warrant initiation of each
of the following stages:
(1) Stage 1: Mild Water Shortage Conditions
a. Requirements for initiation: TRA Water Treatment Plant operates at
greater than 85% of capacity for seven consecutive days.
b. Actions:
1. Inspect treatment facilities and distribution system; make repairs
where necessary.
2. TRA and city manager request voluntary reduction in water use.
3. Inform and educate public on water conservation techniques
through flyers and mailouts.
4. Work to achieve 5% reduction in daily water demand.
5. Prohibit non - essential uses by city government, e.g. street washing,
vehicle washing, operation of ornamental fountains.
6. Request a reduction in landscape watering by city.
7. Request voluntary limit to landscape irrigation at each service
address to once every five days based on the last digit of the
address per the schedule below.

C. Requirement for Termination: Once Stage 1 of the Plan has been
triggered, it will remain in effect until September 30 of the year in which it
was triggered or until terminated by the City Manager or his/her designee.
(2) Stage 2: Moderate Water Shortage Conditions.
a. Requirements for initiation: TRA Water Treatment Plant operates at
greater than 90% of capacity for seven consecutive days.

b. Actions.
1. Continue all Stage 1 actions; with the following modifications and /or
additions.
2. Begin mandatory water use restrictions as follows: prohibit hosing
off paved areas, buildings, or windows; swimming pool draining and
refilling; washing vehicles by hose (except commercial washes);
operation of ornamental fountains.
3. Work to achieve a 10 % reduction in daily water demand.
4. Begin mandatory limit to landscape irrigation at each service
address to once every five days based on the last digit of the
address per the schedule below.

C. Requirement for Termination: Stage 2 of the plan may be rescinded when
the conditions listed as triggering events have ceased to exist for a period
of 15 consecutive days. Upon termination of Stage 2, Stage 1 becomes
operative.
(3) Stage 3: Severe Water Shortage Conditions.
a. Requirements for initiation: TRA Water Treatment Plant operates at
greater than 95% of capacity for seven consecutive days.

b. Actions:
1. Continue all Stage 2 actions; with the following modifications and/or
additions.
2. Identify additional sources (e.g. pre- arranged interconnections with
neighbors); work with customers to identify necessary deliveries; if
necessary, TRA to initiate pro rata curtailment of water deliveries
(See paragraph 1.1 for explanation of method for making pro rata
allocations).
3. Work to achieve a 15 % reduction in daily water demand.
4. Continue mandatory limit to landscape irrigation at each service
address to once every five days based on the last digit of the
address per the schedule below. There will be no watering allowed
between 8:00 a. m. and 10:00 p. m.

C. Requirement for Termination: Stage 3 of the Plan may be rescinded when
the conditions listed as triggering events have ceased to exist for a period
of 15 consecutive days. Upon termination of Stage 3, Stage 2 becomes
operative.
(4) Stage 4: Emergency Water Shortage Conditions.
a. Requirements for Initiation: The City of Euless will recognize that an
emergency water shortage condition exists when any of the following
occur:

• A major water line breaks, or pump or system failure occur, which
cause unprecedented loss of capability to provide water service; or
• Natural or man -made contamination of the water supply source occurs.
b. Actions:
Continue /Implement all Stage 3 actions; with the following
modifications and /or additions.
2. TRA to work with customers to identify necessary deliveries; if
necessary TRA to initiate pro rata curtailment of water deliveries
(See paragraph (a) for explanation of method for making pro rata
allocations).
3. Prohibit all public water uses not required for health or public safety
(i.e. no landscape watering, no outside use watering).
4. If system failure or contamination of water supply, undertake
necessary actions, such as repair or cleanup, to solve the problem.
C. Requirement for Termination: The emergency water shortage condition
may be rescinded when the City Manager or his/her designee, or the TRA
General Manager or his /her designee deems appropriate.
SECTION II
Severability Clause. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph or section of this
ordinance shall be declared invalid or unconstitutional by the valid judgment or decree
of any court of competent jurisdiction, such invalidity or unconstitutionality shall not
affect any of the remaining phrases, clauses, sentences, paragraphs and sections of
this ordinance, since the same would have been enacted by the City Council without the
incorporation in this ordinance of any such invalid or unconstitutional phrase, clause,
sentence, paragraph or section.
SECTION 111
Saving Clause. That Chapter 86 of the Code of Ordinances, City of Euless,
Texas, as amended, shall remain in full force and effect, save and except as amended
by this ordinance.
SECTION IV
Effective Date. This ordinance shall be in full force and effect from and after its
passage and publication as provided by the Euless City Charter and the laws of the
State of Texas.

regular meeting of the Euless City Council on the 13th day of September, 2005, by a
