HomeMy WebLinkAbout1699 08-30-2005ORDINANCE NO. 1699 AN ORDINANCE AMENDING CHAPTER 30, "FEES ", SECTION 30 -15, "FIRE PREVENTION "; SECTION 30 -26, "SWIMMING POOLS "; SECTION 30 -27, "RECREATION AREAS OR FACILITIES ", AND SECTION 30 -28, "LIBRARY ", OF THE EULESS CODE OF ORDINANCES; PROVIDING A SAVING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL, CITY OF EULESS, TEXAS: SECTION I THAT Section 30 -15 "Fire Prevention Code" of Chapter 30 "Fees" of the Code of Ordinances of the City of Euless, Texas, be replaced in its entirety and hereby amended to hereafter be and read as follows: Sec. 30 -15. CONSTRUCTION PERMITS *Ali construction permits, unless otherwise specified herein, are charged a fee based on the cost of the work to be performed. The fee table used is the same table used for valuing miscellaneous permits as specified in Section 30 -13 (d) of this Code. Swimming Pools. Swimming pool daily entrance 1.00 Swimming pool coupon book for 25 passes 20.00 Pool rental per hour 25.00 Pool lifeguard during rentals, per hour, per lifeguard 10.00 (1 lifeguard for every 25 people with a minimum of 2 lifeguards) SECTION III THAT Section 30 -27, "Recreation areas or facilities, (d) "Midway Recreation Center," (2) "Midway Recreation Center Memberships," a. "Residents ", of Chapter 30 "Fees," of the Code of Ordinances of the City of Euless, Texas, be hereby amended by adding 13. "Student Membership" to read as follows: Sec. 30 -27. Recreation areas or facilities (d) Midway Recreation Center: (2) Midway Recreation Center Memberships a. Residents: 13. Student Membership (18 -24 years with college or school ID) .................... $25.00 Valid each year May 15 to August 15 Includes: gym use, walking /jogging track, game area, shower use, ID card, unlimited weight room visits. SECTION IV THAT Section 30 -28, "Librar/', Subsection (1) "Library Materials and Facilities ", of Chapter 30 "Fees," of the Code of Ordinances of the City of Euless, Texas, be hereby amended to add the following fees: Sec. 30 -28. Library (1) Library materials and facilities. That applicable chapters of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION VI SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. SECTION VII EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas.
