HomeMy WebLinkAbout1726 02-28-2006ORDINANCE NO. 1726 AN ORDINANCE AMENDING ARTICLE III, "OPERATION OF VEHICLE," CHAPTER 82, "TRAFFIC AND MOTOR VEHICLES," SECTION 82 -62, "SAME -ON CERTAIN STREETS AND PORTIONS OF STREETS," OF THE EULESS CODE OF ORDINANCES AMENDING THE SPEED LIMIT FOR AIRPORT FREEWAY, E. (STATE HIGHWAY 183) AND AIRPORT FREEWAY, W. (STATE HIGHWAY 183) AND ESTABLISHING THE SPEED LIMIT FOR THE MAIN LANES ON STATE HIGHWAY 360; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING AN EFFECTIVE DATE; AND PROVIDING A SEVERABILITY CLAUSE. WHEREAS, the City of Euless desires to amend the speed limit on a portion of Airport Freeway, E. (State Highway 183) and on Airport Freeway, W. (State Highway 183) and desires to establish the speed limit on the main lanes of State Highway 360; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION I THAT Section 82-62 entitled "Same — On certain streets and portions of streets," of Article III, entitled "Operation of Vehicle," of Chapter 82, entitled "Traffic and Motor Vehicles" of the Euless Code of Ordinances is hereby amended to increase the speed limit at night from 55 mph to 60 mph for vehicles traveling upon the named street or parts thereof as follows: a) On the main lanes of Airport Freeway, East (State Highway 183) (0 Block — 900 E Block) from Euless Main Street, N. east to Bear Creek Parkway (Ft. Worth city limits) b) On the main lanes of Airport Freeway, West (State Highway 183) (0 Block — 1000 W Block) from Euless Main Street, N. west to Industrial Boulevard, N. (Bedford city limits) SECTION 11 THAT Section 82-62 entitled "Same — On certain streets and portions of streets, " of Article III, entitled "Operation of Vehicles, " of Chapter 82, entitled "Traffic and Motor Vehicles" of the Euless Code of Ordinances is hereby amended to establish a speed limit for vehicles traveling upon the named street or parts thereof, as follows: 60 mph on the main lanes on State Highway 360 (400 Block — 3000 N Block) from 1200 feet south of Midway Drive (Ft. Worth city limits) north to Glade Road (Grapevine city limits) SECTION III Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in accordance with Chapter 1, Section 1 -12, Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION IV This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas. SECTION V That it is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section. PRESENTED AND APPROVED ON FIRST AND FINAL READING at a regular meeting of the Euless City Council on the 28th day of February, 2006, by a vote of 6 ayes, 1 nay and 0 abstentions.
