AN ORDINANCE OF THE CITY OF EULESS, TEXAS, AMENDING
CHAPTER 30, "FEES ", OF THE CITY OF EULESS CODE OF
ORDINANCES BY ADDING A NEW SECTION 30-45, "GAS WELL PERMIT
AND CONTRACT FEES"; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING A SAVINGS CLAUSE; AND AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Euless, Texas, adopted Chapter 40
"Gas Drilling and Production" in February 2005, and,
WHEREAS, the fees referenced in Chapter 40, Section 40-4, "Inspection ", which
authorizes the City Manager to enter into a professional services contract with an
individual or entity for the provision of services related to compliance with the provisions of
Chapter 40 and all applicable laws, rules, regulations, standards and directives of the
State related to the drilling and associated activities, have not been formally adopted by
the City Council of the City of Euless, Texas; and,
WHEREAS, the fees referenced in Chapter 40, Section 40 -22 (b) "Gas Well Permit
Application and Filing Fees ", have not been formally adopted by the City Council of the
City of Euless, Texas; and,
WHEREAS, the fees referenced in Chapter 40, Section 40 -22 (b) "Gas Well Permit
Application and Filing Fees ", which establishes reimbursement of actual costs to the City
for the services of a technical expert to review the application and /or information
supplement, related to compliance with the provisions of the Chapter 40 and all applicable
laws, rules, regulations, standards and directives of the State, have not been formally
adopted by the City Council of the City of Euless, Texas; and,
WHEREAS, the Euless City Council finds and determines that there is practical
benefit to adopt fees associated with the administration and implementation of the
provisions of Chapter 40 "Gas Drilling and Production" that will promote the health, safety
and general welfare of the citizens of the City of Euless, Texas.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF EULESS, TEXAS:
SECTION I
THAT Section 30, "Fees ", of the Euless Code of Ordinances, be amended, by
adding a new Sec. 30-45, "Gas Well Permit and Contract Fees ", which shall hereafter be
and read as follows:
Sec. 3045 Gas Well Permit and Contract Fees
New gas well permit (for boring a new well) $1,500.00
Amended permit $ 540.00
Extended permit $ 270.00
Supplemental permit (change in depth or
use from current permit) $ 180.00
Operator transfer $ 720.00
Seismic site inspection $ 360.00
Annual fee (per well) $ 500.00
Contract fee for technical expertise
(per each new, supplement, or
amended application review) $ 5,000.00
(not to exceed
amount for
actual
expenses)
Contract fee for Gas Well Inspection
Services Provider (per gas well /each major
activity inspection, including drilling, redrilling,
re- working, fracture stimulation) $ 5,000.00

SECTION II
SEVERABILITY CLAUSE. That it is hereby declared to be the intention of the City
Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance
are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance
shall be declared invalid or unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since
the same would have been enacted by the City Council without the incorporation in this
ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or
section.
SECTION III
SAVING CLAUSE. That the Code of Ordinances, City of Euless, Texas, as
amended, shall remain in full force and effect, save and except as amended by this
ordinance.

SECTION IV
EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its
passage and publication as provided by the Euless City Charter and the laws of the State
of Texas.
PRESENTED AND GIVEN FIRST READING AND FINAL READING at a regular
meeting of the Euless City Council on the 281h of November, 2006, by a vote of 7
ayes, o nays, and o abstentions.
