AN ORDINANCE PROHIBITING THE RETAIL SALES OF CERTAIN
GOODS, WARES, AND ITEMS AND THE SALE OFSERVICES ON
SUNDAY WITHIN THE CORPORATE LIMITS OF EULESS, TEXAS;
PROVIDING CERTAIN EXCEPTIONS; PROVIDING A PENALTY
THAT ANY PERSON, FIRM, OR CORPORATION VIOLATING
ANY OF THE PROVISIONS OF THIS ORDINANCE SHALL
BE DEEMED GUILTY OF A MISDEMEANOR AND UPON CONVICTION
THEREOF SHALL BE FINED A SUM NOT LESS THAN TEN DOLLARS
AN NO MORE THAN TWO HUNDRED DOLLARS;;PROVIDING A
SEVERANCE CLAUSE; AND PROVIDING FOR PUBLICATION AND
AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS:
1.
It shall be unlawful for any person, on both the two (2)
consecutive days of Saturday and Sunday to sell, offer for sale
or compel, force or oblige his employees to sell any clothing;
clothing accessories; wearing apparel, footwear; headwear;
home, business, office or outdoor furniture; kitchenware;
kitchen utensils; china; home appliances; stoves; refrigerators;
air conditioners; electric fans; radios; television sets;
washing machines; driers; cameras; hardware; tools, excluding
non -power driven hand tools; jewelry; precious or semi- precious
stones; silverware; watches; clocks; luggage; motor vehicles;
musical instruments; recordings; toys, excluding items cus-
tomarily sold as novelties and souvenirs; mattresses; bed
coverings; household linens; floor coverings; lamps; draperies;
blinds; curtains; mirrors; lawn mowers or cloth piece goods.
Each separate sale shall constitute a separate offense.
II.
It shall be unlawful for any person on both the two (2)
consecutive days of Saturday and Sunday to sell or offer for
sale or compel, force or oblige his employees to sell any
maintenance service, supply service, repair service, instal-
lation service, distribution service, personal service or
professional service. Each separate sale and /or offer for
sale shall constitute a separate offense.
III.
Exceptions
The prohibition herein shall not apply to any sale or
sales for charitable purposes or to items used for funeral or
burial purposes nor to items sold as a part of or in conjunc-
tion with the sale of real property nor to the sale of
newspapers, food or grocery products, drug and pharmaceutical
sales, hotels, boarding houses, restaurants, bathhouses,
nor to sales of gasoline or other motor fuel nor to vehicle
lubricants or other normal service station sale items, nor
to necessary work on farms, dairies or ranches, nor to motion
pictures or theatres, nor to the sale of services by doctor
or dentist for the preservation of human life and relief of
human suffering.
IV.
When a purchaser will certify in writing that a purchase
of an item of personal property is needed as an emergency for the
welfare, health or safety of human or animal life and such
purchase is an emergency purchase to protect the health, wel-
fare or safety of human or animal life, then this Ordinance
shall not apply; provided such certification signed by the
purchaser is retained by the merchant for proper inspection
for a period of one (1) year.
V.
Any person, firm or corporation violating any provision
of this Ordinance shall be deemed guilty of a misdemeanor and
upon conviction thereof, shall be fined in a sum not less than
$10.00, or more than $200.00. Each day such violation continues
shall constitute a separate and distinct offense.
V1.
Should any section, article, provision or part of this
Ordinance be declared to be unconstitutional and void by a
court of competent jurisdiction, such decisions shall in no
way affect the validity of any of the remaining parts of this
Ordinance unless the part held unconstitutional or void is
inseparable to the operation of the remaining parts. The City
Council hereby declares that it would have passed those parts
which may be unconstitutional at the time of the passage of
this Ordinance.

VII.
This Ordinance shall become effective and be in full force
and effect from and after the date of its adoption and publi-
cation as by law provided.
