AN ORDINANCE AMENDING CHAPTER 10, "ANIMALS," ARTICLE III,
"CARE AND CONTROL," OF THE EULESS CODE OF ORDINANCES
BY ADDING SECTION 10 -74, "REGISTRATION OF DOGS AND CATS ";
AMENDING CHAPTER 30, "FEES," SECTION 30 -4, "ANIMALS,"
PROVIDING AN EFFECTIVE DATE; AND PROVIDING A
SEVERABILITY CLAUSE.
WHEREAS, the City of Euless desires to amend Chapter 10, "Animals," to add a
new section providing for the registration of dogs and cats within the City of Euless; and
WHEREAS, the City of Euless desires to amend Chapter 30, "Fees," to add a fee
for registration of dogs and cats when picked up by Animal Control; and
WHEREAS, registration of dogs and cats will provide an opportunity to locate the
owner of dogs or cats picked up by Animal Control.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF EULESS:
SECTION 1
THAT Article III entitled, "Care and Control," of Chapter 10, entitled, "Animals," of
the Euless Code of Ordinances is hereby amended to add a section as follows:
Section 10 -74 Registration of Dogs and Cats
(a) Any person owning or harboring any dog or cat or allowing such
dog or cat to reside or be domiciled within the City of Euless may
register such dog or cat and obtain a registration tag for such dog
or cat.
(b) The owner or harborer of a dog or cat in the City of Euless will be
issued a registration tag upon certification of current rabies
immunization in accordance with Article V. Rabies Control. The
registration will be without charge.
(c) Registration of a dog or cat may be performed at the City of Euless
Animal Shelter or by other means that may be established by the
City of Euless in the future. Registration information shall include
but not be limited to the name, address, e-mail address and phone
number of the owner or harborer, the breed, sex and coloring of the
dog or cat registered, rabies tag number and the name and address
of the veterinarian administering the rabies immunization.
(d) A dog or cat at large that is picked up by the City of Euless Animal
Control that does not have a City of Euless registration tag will be
required to be registered. The owner or harborer of such dog or cat
will be charged a registration fee as set forth in Chapter 30, "Fees ",
Section 4, "Animals," prior to the release of such dog or cat to the
owner or harborer.
SECTION 2
THAT Chapter 30, "Fees," Section 4, "Animals," of the Euless Code of
Ordinances is hereby amended by adding the following Subsection to hereafter be and
read as follows:
(1) Registration fee for dogs and cats without City of Euless registration tag
picked up by the City of Euless Animal Control .......................... $10.00
SECTION 3
THAT this ordinance shall be in full force and effect from and after its passage
and publication as provided by the Euless City Charter and the laws of the State of
Texas.
SECTION 4
THAT it is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance are severable,
and if any phrase, clause, sentence, paragraph or section of this ordinance shall be
declared invalid or unconstitutional by the valid judgment or decree of any court of
competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the
remaining phrases, clauses, sentences, paragraphs and sections of this ordinance,
since the same would have been enacted by the City Council without the incorporation
in this ordinance of any such invalid or unconstitutional phrase, clause, sentence,
paragraph or section.
PRESENTED AND APROVED ON FIRST AND FINAL READING at a regular
meeting of the Euless City Council on the 27th day of May, 2008, by a vote of 6
ayes, 0 nays, and 0 abstentions.
