Home My WebLink About1866 01-12-2010ORDINANCE NO. 1866 AN ORDINANCE AMENDING ARTICLE I "IN GENERAL" OF CHAPTER 66 "SOLID WASTE " OF THE CODE OF ORDINANCES OF THE CITY OF EULESS, TEXAS; ADDING A NEW SECTION 66 -1, "CONTAINER PLACEMENT AND REMOVAL TIME PERIODS ", AS SET FORTH HEREIN; PROVIDING FOR A PENALTY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE AND EFFECTIVE DATE. WHEREAS, Chapter 66, "Solid Waste" of the Euless Code of Ordinances contains provisions governing solid waste collection and disposal services within the city; and WHEREAS, the City Council of the City of Euless hereby finds and determines that the following provisions are necessary to be included in Chapter 66 for the health, safety, and welfare of the citizens of the City of Euless, Texas. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS, TEXAS: SECTION 1 THAT Article I "In General" of Chapter 66, "Solid Waste ", contain a new Section 66 -1 "Container Placement and Removal Time Periods" of the Code of Ordinances of the City of Euless, Texas, as amended, to read as follows: Sec. 66 -1. "Container Placement and Removal Time Periods" Refuse and rubbish placed in garbage containers, or residential repair debris and bundle or boxed bundle, or recycling collection, shall not be placed out before 7:00 p.m. on the day prior to the scheduled pickup. Emptied containers shall be removed no later than 7:00 a.m. on the day after the scheduled pickup. Garbage containers not stored within the main structure or permitted accessory structure must meet the requirements in Section 84 -337 (b) "Open storage and use areas ". SECTION 2 PENALTY CLAUSE. An offense under this section is punishable by a fine as set forth in accordance with Chapter 1, "General Provisions ", Section 1 -12, "General Penalty," Euless Code of Ordinances. Each instance of a violation of this section is a separate offense. SECTION 3 SEVERABILITY CLAUSE. It is hereby declared to be the intention of the City Council of the City of Euless, Texas, that the sections, paragraphs, sentences, clauses, and phrases of this ordinance are severable and if any phrase, clause, sentence, paragraph, or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, or sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase. SECTION 4 SAVINGS CLAUSE, Chapter 66, "Solid Waste ", of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 5 EFFECTIVE DATE. This ordinance shall be in full force and effect from and after its passage, as provided by the Euless City Charter and the laws of the State of Texas.
