Home My WebLink About1903 02-22-2011ORDINANCE NO. 1903 AN ORDINANCE AMENDING CHAPTER 82 "TRAFFIC AND MOTOR VEHICLES," ARTICLE III "OPERATION OF VEHICLE," SECTION 82 -67 "SAME -- STREETS DESIGNATED; EMERGENCIES; TRUCK TRAFFIC CONFINED; EMERGENCY VEHICLES EXCEPTED," TO PROVIDE FOR THE DESIGNATION OF TRUCK ROUTES IN THE CITY OF EULESS; PROVIDING A PENALTY FOR VIOLATION THEREOF; PROVIDING A CUMULATIVE CLAUSE; PROVIDIING A SEVERABILITY CLAUSE; PROVIDING A SAVING CLAUSE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Euless has previously designated specific streets and highways within the city limits as truck routes for truck traffic traveling within the city as set forth in Section 82 -67 of the City Code; and WHEREAS, the City of Euless desires to have additional streets, highways and thoroughfares in the city designated as truck routes; and WHEREAS, these additional truck routes will allow truck traffic to drive through our city with greater safety; and WHEREAS, the City of Euless also desires to clarify the existing list of designated truck routes; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF EULESS TEXAS, that Chapter 82 "Traffic and Motor Vehicles," Article III "Operation of Vehicle," Section 82 -67 "Same -- Streets designated; emergencies; truck traffic confined; emergency vehicles excepted," be hereby amended by replacing sub - section (a) as follows: SECTION 1. (a) Streets designated. The following streets, highways and thoroughfares in the city shall be mandatory truck routes: (1) State Highway No. 183 (Airport Freeway); (2) FM Highway No. 157 (Industrial Boulevard); (3) State Highway No. 10 (Euless Boulevard), (4) Harwood Road; (5) State Highway No. 360; (6) Westpark Way between S. Pipeline Rd. and State Highway No. 10; (7) Raider Drive from S. Pipeline Rd. to W. Pipeline Rd; (8) Heather Drive between S. Pipeline Rd. and State Highway No. 10; (9) S. Pipeline Road; (10) S. Ector Drive between State Highway No. 183 and State Highway No. 10; (11) State Highway No. 121, (12) Mid - Cities Blvd. between FM Highway No. 157 and State Highway No. 360; (13) West Pipeline Road between Raider Drive and Central Drive. SECTION 2. Penalty for violation. Any person, firm or corporation violating any of the terms and provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction shall be fined in accordance with Chapter "General Provisions," Section 1 -12 "General Penalty," Euless Code of Ordinances. Each such violation shall be deemed a separate offense and shall be punishable as such hereunder. SECTION 3. Cumulative Clause. This Ordinance shall be cumulative of all provisions of the City of Euless, Texas, except where the provisions of this ordinance are in direct conflict with the provisions of other ordinances, in which event the conflicting provisions of the other ordinances are hereby repealed. SECTION 4. Severability Clause. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared invalid or unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such invalidity or unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such invalid or unconstitutional phrase, clause, sentence, paragraph or section SECTION 5. Saving Clause. Chapter 82 of the Code of Ordinances, City of Euless, Texas, as amended, shall remain in full force and effect, save and except as amended by this ordinance. SECTION 6. Effective Date. This ordinance shall be in full force and effect from and after its passage and publication as provided by the Euless City Charter and the laws of the State of Texas.
